I am a salaried exempt software engineering manager with many years experience and have never been fired.

This hot shot internet shoe store (with a philosophy for providing the best customer service) hired me mostly on phone interviews and on one site interview. But when I started they started asking me my age saying I looked younger then I was.

Then one employee stared making age comments, there where other comments and I just .avoided them, it was clearly a hostile environment for me, but I was determined to stick it out.

After only 4 weeks I companied to my manager, some of the things here where not productive because of the negative comments and postings (like eating certain body fluids), That I was forced to read as I logged into the system. The very next day they fired me for being exactly 2 minutes late, after we had both agreed that relocation (they provided 5,000 in relocation money) should come first and may interfeer with some job duties. Too weeks before I had asked for a day off for relo and it was granted as don't even ask if you can do your work around it do what you need to do.

Now I have lost everything, the move was to another state and I am now practically homeless and with out much money, most of my furniture was donated so I could keep the move as low cost as possible. They only paid me to date and then when I was crying and upset at the firing, they (the development manager and HR person) actually laughed and said I was old enough to survive.

I have the skills and no one questioned that, I was friendly and upbeat, I have been a manager for a god many years with great referrals. I do agree that because they sell shoes on line they would think like that but they assured me it was not like it. The customer support team (CLT) have hard start times and even need to punch a time clock ever day (imagine that at such a internet progressive company treats humans like animals).

The key for me is that I did not punch a time clock I had zero documents that showed a hard start time and other people where also late at that meeting and did not get fired, I have the skills to do my job, I fit in well and had emails saying so. But this company only has young young employees and made age comments to me And they disguised the firing using a policy that did not ever apply to me to cover it..

Maybe they got a look at your spelling. Or, your ability to compose a structured sentence, and to communicate your ideas clearly, and found those skills to be sorely lacking.

If you feel you have a claim based on age or other factors, file a cliam with the EEOC or your state human rights division.

Yes, willma, how old are you? What was the position for which you were hired? And did you get the $5000 in relocation funds?

If you didn't punch a timeclock, why are you so irate that other employees had to?

It was not illegal to fire you for being two minutes late. Nv. is an at-will employment state & you can be fired at any time for any reason not protected by law such as sex, age, religion, etc, or unless you had a bona fide employment contract or CBA to the contrary.

If you believe you were fired JUST because of your age (40 & older), put in a claim with the EEOC.
