I have a HOA on a town home I own. They are responsible for outside maintenance to the unit excluding windows and doors. I paid the dues up for over a year and never saw any repairs done to the siding in the back that was deteriorating. I called repeatedly and was given the brush off or told simply that they didn't have the money for the repairs and to repair it myself. After seeing no results I stopped paying the dues. Now after 3 years I have a lien on my unit and have been served papers by the sheriff for the back dues. 30% of the residents in the neighborhood have also quit paying their dues for similar reasons and there seems to be a conflict of interest as the board members units are always the ones that see any repairs or upkeep done. Is there a way to form a class action suit against the HOA or a way to dissolve it completely? I don't mind paying back the dues that are owed but I have a real problem with handing out $184 every month for nothing. The dues cover a pool thats open Memorial to Labor day, a trash dumpster, and weekly lawn service. That seems really pricey for those things and over a quarter of the residents agree. The HOA have meetings maybe twice a year and other than that no one is kept in the clear about anything.
