20-yr old daughter came out of her apartment and slipped on freshly painted stairs, tumbling straight down about a dozen. She had her hand on the railing, but it slipped off as she fell because it was freshly painted, too. (We have pics to prove.) She suffered severe bruising on legs and torso, but no "serious" injury. According to property manager, painter was supposed to have posted signs and notified tenants before painting but failed to do so. Painter's insurance has verbally accepted liability.
I have calculated the tangible costs (ruined clothes, lost wages, medical costs, etc.) Still, I have no idea what the "pain and suffering" might be worth. She was badly bruised, and we have pictures of her back and legs clearly depicting the injuries. We have witness statements that note her lying at the bottom of the stairs and in apparent pain. We have the emergency doc's report and treatment record. (She was on oxycontin for a week, and missed three days of work.) She's a full-time college student and part-time vet tech.
Need to prepare a demand letter to the insurance company, and would prefer to not deal with lawyers 1) for convenience, and 2) it's apparent "small potatoes" nature. Suggestions?What is the name of your state?
