CS ordered in TX now we live in AR.

The cs order was for Texas 6 yrs ago we have since both moved to different parts of Arkansas ... He moved 2+ yrs ago .. I have been here for 1yr...There hasn't been any adjustments since it was final... Texas has a $cap on cs & he had reached it with his income level .... Now 6+ yrs later taking 24hr, 7days a week care for 2 growing teenage boys ....(that I dearly LOVE & ENJOY) I would really like to increase & modify cs , how do I domesticate the orginal order to arkansas and request an increase of cs... I do know that TX takes 25% (but has a $1500 cap) for 2 and AR takes 21% (i believe) with no cap ... How do i do all of this and not be out an arm & leg?? In the past 6yrs he has moved twice and has had 2 promition with one of them taking place just a few months ago??? He does see them 2-4 days a month.... I haven't modified visitation order, he just gets them a couple of days out of the month when he can travel the 5hrs to see them ..... Thank you for all you advice ... This is a great site... Generally, you CAN domesticate a child support order for the purposes of enforcement - so basically AR would enforce your TX order for TX.

But you usually can't change which state's guidelines are used to figure that support...

He has hit the cap in TX and when you ask for mod. there all you have to do is show just cause of the extra expenses and needs for the children ...... however AR does not have a cap ???

You will not be able to use Arkansas' guidelines to modify your support. AR may COLLECT for you, and they may even handle any modifications. But they will not set a new support amount using AR guidelines - this is called 'forum shopping' and it's not allowed.

Yes, the state guidelines apply to the first $6000 of monthly income. Does your child(ren) have some sort of special needs that would warrant an increase above and beyond? If so then maybe you can possibly petition for more, but it doesn't mean that it would be granted.

§ 154.126. APPLICATION OF GUIDELINES TO NET RESOURCES OF
MORE THAN $6,000 MONTHLY. (a) If the obligor's net resources
exceed $6,000 per month, the court shall presumptively apply the
percentage guidelines to the first $6,000 of the obligor's net
resources. Without further reference to the percentage recommended
by these guidelines, the court may order additional amounts of
child support as appropriate, depending on the income of the
parties and the proven needs of the child.
(b) The proper calculation of a child support order that
exceeds the presumptive amount established for the first $6,000 of
the obligor's net resources requires that the entire amount of the
presumptive award be subtracted from the proven total needs of the
child. After the presumptive award is subtracted, the court shall
allocate between the parties the responsibility to meet the
additional needs of the child according to the circumstances of the
parties. However, in no event may the obligor be required to pay
more child support than the greater of the presumptive amount or the
amount equal to 100 percent of the proven needs of the child.

OP was pulling up Adoption threads and telling the posters that she knows of a couple that is looking to adopt...bizarre...The post were reported to Admin as they are in clear violation of the TOS of FA.
