Last tennant owes for damages.

What is the name of your state? OH

My last tennat owes over a 1K in damages over and above the deposit. I have sent them an accounting of the charges and demanded payment within 30 days or legal action will be taken to recover the damages.

The tennant has moved out of state. When his 30 days are up do I face any commplications by filing small claims in the county that the damages occured in regradless that he has now moved?

Nope. Not at all.

He moved to Michigan. I do not believe they have lived there long enough to establish residency. Does that matter? The company that relocated the family is based in Ohio as well - which probably doesn't matter.

Let me see if I can ask the right question as johnd suggests. What is the best course of action for me to recover the damages from the tenant?

In VA, the secretary of the state of VA can serve court paperwork on someone out of the state - so ck OH laws on this....That should NOT stop you for prosecuting your claim for the additional damages.

The person can be served by mail, or personal service in whatever state they are in, whether or not they've established residency. For example, if the def. took a 2 month vacation to Hawaii, one could effect service on them in Hawaii.
(I read up on that one ;) )

You might also want to check whether, if you get a judgement on him in OH, you will be able to have it domesticated in MI so that you can actually take action to collect (wage garnishment or bank levy etc).
