What is the name of your state? Vt.. Lets say someone rents a space in a building and starts a business in this leased space. This building is leased for 3 years. Now, lets say someone sells the business and all assets to another person. Can the original renters force the buyer of the business to move the business to another location if they are still the only ones on the lease we want to keep the space to start another business. The landlord is not aware we sold the business to another person and this person thinks the space comes with the business.

Why would the new biz owner think that the rented space came with the purchase? What does the purchase agreement say regarding the location?

And does the lease list the business name or just your personal name as the tenant?

It is a bingo...and the is purchase agreement states only for ownership of bingo and its equipment. But, since the bingo is in this rented space the new owner is running it in the same space. We want him out of our rented space so we can re-organize. Now this new owner says he will get on the lease and take over space since he bought the business as a running business. I told him he needs to find another place to find. He is arguing that when he bought the business the space came with it. It has our name as tenants....but other are listed as guarantors, but those guarantors are no longer in the business anyways. What can we do?

YUP. I am not a partner. But my mom is owner of 20%, and she is 71 years old. She has worked her tail off for the last year with two sponsors diligently. My older brothers saw $$$ signs and talked the 50% owner (a selfish abusive 35 year old I will call $cum and still living with...guess who...mom) into buying him out. $cum never mentioned it to her, until the exchange was made. My mom is physically sick over this. Even though $cum put up the money, this had become my mom's lively hood, her social interaction with friends and neighbors. Now my $$$ hungry brother will not even let her into the place....this is why I wanted to know about the rent. Anyways, after talking to her today, she is depressed and feeling completely defeated. I am angry and feeling very frustrated in how our mother was used and shoved aside. I am accused of putting my nose in where it does not belong, and now my mom is telling me to let it go. She has no energy to kick out the Scumbag. He drinks, smokes pot, calls her names, uses the f word constantly in front of my mom and grandmother. When he gets mad he slams doors, throws things. Mainly when he is drunk. She has guilt with him, because she left him when he was younger. Well, she left all us kids, and we got over it, and I still love her. He makes her feel like she owes him. Can I help in some way? I am beside myself with anger want to help her, I don't think she will do anything, she is afraid of her boys hating her. Can you believe that? Please help. Faith

So, is there anything legal I can do to get him at least out of her home? He has lived there room and board free, and I am tired of defending my mom and getting to be the bad buy when she keeps allowing this to happen. I don't think she has the strength or the health to do this on her own. Faith

**A: then have her give you a specific power of attorney and you go hire an attorney for her.

In the purchase of the business, the PURCHASER should have gotten the landlord of the building to AGREE in writing to an ASSIGNMENT of the SELLER's LEASE...absent no assignment of lease from landlord and lessee to the purchaser of the business - yes, the lessee/seller gets to keep the business.

Someone in the process needed a real estate broker familiar with BUSINESS OPPORTUNITY brokerage

When you say gets to keep the business, can the contract of sale be broken then. Is there a time limit that seller can cancel the sale and give back purchasers money?
