I left my husband and filed for divorce while he was unemployed. He volunteered to get laid off (he's in the home building industry) because he had another job lined up to start in 3 to 4 months. Job started 6 months later, but he didn't pass the drug test due to Marijuana. He does have a medical recommendation, but he also gets Vicodin (vicodin/ibuprophin mix), from his doctor for the same condition and abuses both. I also recently found out he's been using crystal meth from my sister on a regular basis before we split up. He still has no job. He really hasn't been looking IMO.
We have 1 minor child. We're trying to do this divorce ourselves, but I'm finding it very difficult to deal with him. He has highs and lows a lot and says I'm never nice to him (I disagree). He insists that if I get an attorney, he will HAVE to get one and I will have to pay his attorney's fees and he is entitled to spousal support. We can't agree on anything, including hiring a realtor to sell the house.
He has always made more money than me, up until now. He also has an uncontrollable spending problem. He cashed in his 401K ($25,000) before we separated and it's gone (went to bills and his fun times). So now he has nothing. I'm paying the mortgage and everything except his credit cards (3 of them).
Will I end up paying his attorney fees and spousal support? We haven't done any parenting agreement yet, but he wants joint legal and physical custody with me as primary physical custoday as the daughter wants to live with me. Should I get an attorney?
