Hi, I recently sold a used car after posting it on Craigs list. I sold the car for $900 to a person that I didnt know. He wrote me a personal check. Before accepting the check, I contacted his bank and verified funds, as well as had him log on to her online banking to make sure there were no pending transactions. Stupid me, instead of cashing the check at his bank, I deposited it in my account at a different bank. Anyhow, a week later, the check is returned to me, he stopped payment. He told me to come get the car because the muffler fell off, he didnt want it. I dont want the car back, I want the money. I assume that I cant pursue passing bad checks charges because he stopped payment, but do I have any recourse besides getting the car back? Can I file a small claims complaint saying that he entered into a binding agreement to purchase the car using the returned check as proof? I gave him the title, but i honestly dont know if it was ever transferred. Any suggestions would be greatly appreciated.
