What is the name of your state? NY

My fiance's mother recently passed away. She owned a co-op but unfortunately did not leave a will. My fiance is currently filing the paperwork with the State to become her heir officially and the co-op cannot be transferred to his name until he receives the letter. The co-op insurance policy is in his mother's name. If something(fire, injury, etc) requiring a claim on the policy occurs would the insurance company uphold the policy of a deceased person or is the policy now void because she is deceased?

Thanks

**A: the cooperative issue is a probate matter. The policy holder beneficiary on the insurance should be the estate.
