Also, A mother can go with out paying CS for 5 years and doesnt plan on paying anytime in the future. She has every ability to work but chooses not to. She never graduated high school but that was her choice. Why will a judge let her off and nothing happen. But if it was the man and they are behind 1000 they go to jail? No questions asked?

Mom's CS arrearage is going to be a factor that a judge will use to determine whether or not it would be in the child's best interests to move away from her. It is not going to be THE factor.

And no... I know of NO ONE who has gone to jail ONLY because they're $1000 in the hole on CS. My son's father was over $2K in the hole when the order was ISSUED.

There are plenty of people who are more than $30K in arrears that aren't in jail.

But, before a judge will DO anything, there has to be something filed either by the OAG or by dad for contempt or non-payment or whatever.

Well, you're making it a gender issue when it's not.

Your father's case is irrelevant as things have changed since then... they rarely send people to jail for non-payment anymore. And just because he was told 'pay or go to jail' doesn't actually mean they would have sent him off to prison.

And the judge WON'T DO ANYTHING unless the OAG takes her to court for non-payment. Dad can walk in there for a modification of custody so he can move and he can throw a fit and stomp his feet and the judge won't care.

My dad moved to TX when we were kids so that he could avoid CS because they would not honor an out of state order against a resident of TX. So he went YEARS w/out paying a dime in CS with not a single consequence. Things have changed since then though. They've changed since your father was not paying support too.
 
I am not saying we want her in jail because if it came down to it my husband would back down so she didnt have to go. AG has had this since 2006 and nothing hashappened. They said they had to send out the three letter before they could do anything that was over and done with almost a year ago and they still did nothing. Thats why myhusband signed the letter so he could get some help. The mother has NEVER purchased a thing for this child. She wears the same clothes we send her in all weekend. Does not own shoes for her, never helpped with school, nothing. It just seems it takes two to make achild but there is no enforcement on two of them having responsibility for a child.
