What is the name of your state? Washington.

I was living in a rental unit that caught fire July 12 of this year, we basically lost everything. I was wondering if I am able to submit a claim to my landlords property damage and/or is liablity homeowners insurance. The fire was cause by the a.c outlet over heating. The a.c unit was installed in a wall that was ventiing into a enclosed garage. I did not have renters insurance at the time, and am kicking myself in the butt for not having it, I do have it now, if only I had known that renters insurance only runs about 25$ a month. Can and how do I make a claim on his insurance?

Very unlikely. As you probably know by now, the landlord's fire policy only covers the building, any property owned by tenants is excluded. The only way you could get at his policy is to prove the landlord to be personally liable. If he hired qualified professionals to install the a.c., then he probably has no liability. There is almost no chance of convincing the insurance company to cut you a check unless you can prove liability, and even then they may fight you all the way to court.

You need to find out if anyone is personally liable for the fire and sue them, assuming you have no liability at all.

I dont know how you could call me cheap, I dont understand how people want to come on here and get frree advice then they have people that just feed into the stuff that people ask and look for something mean to say. Im a 28 year old single mother, and I know not having renters insurance was a bad idea, but me, like alot of other people im sure, thought it will never happen to me, I lived in that same house for 5 years was a great neighborhood, so no one ever broke in, so didnt have to worry about that. Also I lived right across the street from my mother. so I grew up in that neighborhood since I was the age of 5 til I was 18 then moved back there when I was 23 and moved in across the street from my mother. I dont know how you get off calling me cheap, when the loss to me and my 2 boys stuff ran about 15,000$ now how am I being a single mother with a low income as it is take care of 2 boys by my self, and before you go saying where is their father, well he is deceased, so my kids do get survivor benefits, But how in gods creation can I afford to replace stuff that I have been accumilating since I moved out when I was 18 and started getting for my kids 7 years ago. So the conclusion to this reply " Find something better to do then talk bad about people, or think you have any idea how they are " ... Im sure no one wants to come on here looking for free advice and be talked down upon, we have enough of that in this society today. There was no advice at all in your reply to my question.... WOW!

I'm a single mother like you, hon. Renter's insurance has nothing to do with what neighborhood you live in. If my stuff was ruined my loss would be greater than yours. I'm not interested in where the father of your kids is, since that's not the subject of the conversation. In any case, renter's insurance is cheap and necessary. Just like car insurance (if you drive at all - whether or not you own a vehicle), life insurance, and health insurance.

Sounds like Mo hit the nail on the head. You just didn't like reading it.

Why even say something like what she said, about me being cheap. And my awnser to about where I live is because I really didnt think I needed it, and I do have it now. It sounds to me like another one of those females that has to have everything better and more then anyone else... Its allright thou there is alot of females out there like that.
I said something about my boy's father cause you just cant going assuming how someone is without knowing anything about them. Ok and my question was nothing about should I have renters insurance, I asked can I even make a claim. SO get off your pedestal and actually be helpfull on these forums not critisis everyone to make your self feel better, and think it will make you look better as a person, I hope someday the person you critisis will teach you something you claim to allready know.

I spoke to a lawyer and he told me that I can send them a letter stating that I want to be submitted on his insurance, then if they do not reply. I need to go to his office and sign some papers and he will file a lawsuit. He said his Liablility covers the damage to the tenants property if any. WOW in 14 yrs in insurance that is one policy limit I have never seen! I think you are going to be sadly disappointed when you read the exclusions of the landlord's policy.
