Employer refuse too pay!

What is the name of your state? Florida. Dealing with a Federal Contractor. will call situation scheduled and non-scheduled work. On the schedule for a report time, reported for work. The assignment had been cancelled,I was not notified,mangement had post a notice "hand written" earlier that we should call in prior too reporting. We have a Union this is "not" in the contract too call before. Management said we will not pay you for your time, per union contract when on schedule and not used person shall get "3 hours of pay"
Currently in process for grievance 2-8 weeks.
The question is should I follow threw on the grievance or is this some thing should be taken care of in a "Timely Manor" Knowing I'm dealing with a Federal Agency contractor. I have been down this slippery slope before and went threw the State Labor Board and it drag on for months and finally got tossed do too a time element.Their more too this that what has been just described involving harassment and intimidation and the good ole boys way of conducting business**************.:(What is the name of your state? The grievance is the only recourse you have. No federal or state wage payment law requires that you be paid "reporting pay" when you report for work, but are provided with fewer than your scheduled hours of work for the day (even if that is zero).

If you are indeed working for a federal contractor, call the U.S. DOL and file a complaint, they are obligated to investigate any complaint involving the Service Contract Act. I know, because I have worked for federal contractors for years and any time there is a wage complaint, the DOL investigates PERIOD.

No not at all, but it could be worked into the contract or the OP's collective bargaining agreement which he/she hasn't provided information about. I seriously doubt it is in the contract for the job as I have never seen this done and the government isn't real keen on reimbursing the contractor for these types of payment.

The state FLORIDA**************.. The agreement with the contractor of a minimum of 3 hours of pay if not used......The grievance process is started, I was just wonder about should I file with the DOL or just wait till all the paper work is returned from the grievance process. I'm more concerned about the time factor and having too refile with another agency do too apathy on the union side**************.Thanks too all for the input.Lost in FLORIDA**************.:(

Is this language in the collective bargaining agreement?

Yes the language is their,...Problem lies that every one is too fearful too stand up.What occurred is on the duty rooster last week one of the management decided too hand write a memo on top of the rooster that it's every ones responsibility too call in and inquire if their working, The person that hand wrote that note DID NOT go threw the union.that member of management is also in the "'Union""> Talk about strange bed fellows**************:( So every one like lambs too the slaughter agreed....If you disagree then you are some what retaliated against and loose work hours. So the vast majority just go with the flow**************..:( **************Thanks

Can any one give me a bench mark on how long this process takes. I am concerned about a time factor, on filing a claim with the Wage & Hour Board if the grievance is turned down**************... :( Any suggestion? :confused:
