What is the name of your state? Colorado

Here's my story:

I sold a PS2 online, I sold it to a lady in New Mexico. She told me she was sending the money, so I sent her the system. I've been trying to get her to pay me the money for it since last November. She's claimed that she has tried mailing it twice, she said she would pay through pay-pal, and that was unsuccessful, she even said she tried wiring me the money. Every time I try to ask for a confirmation number she's unable to produce one. A few months after she recieved the system she finally got around to telling me that the PS2 quit working a week after she received it. I know it was working when I sent it to her, So would it be my fault that it stopped working. I've apologized to her, but why would she wait so long to tell me, why couldn't she tell me right away? I believe she was just trying to get out of having to pay for it. We e-mailed several times between that peirod of time. So, if anyone can give me any advise as to what to do. I could really use the advise.

Thanks

Avoiding scams and fraud craigslist help forum

You can sidestep would-be scammers by following these common-sense rules:

* DEAL LOCALLY WITH FOLKS YOU CAN MEET IN PERSON - follow this one simple rule and you will avoid 99% of the scam attempts on craigslist.

* NEVER WIRE FUNDS VIA WESTERN UNION, MONEYGRAM or any other wire service - anyone who asks you to do so is a scammer.

* FAKE CASHIER CHECKS & MONEY ORDERS ARE COMMON, and BANKS WILL CASH THEM AND THEN HOLD YOU RESPONSIBLE when the fake is discovered weeks later.

* CRAIGSLIST IS NOT INVOLVED IN ANY TRANSACTION, and does not handle payments, guarantee transactions, provide escrow services, or offer "buyer protection" or "seller certification"

* NEVER GIVE OUT FINANCIAL INFORMATION (bank account number, social security number, eBay/PayPal info, etc.)

* AVOID DEALS INVOLVING SHIPPING OR ESCROW SERVICES and know that ONLY A SCAMMER WILL "GUARANTEE" YOUR TRANSACTION.

Wow butterfly21, I mean seriously that's the very last thing you ever do, I've never had anyone send me any merchandise I've won, or purchased, on the net without them getting my payment first, nor have I ever shipped out anything at all before receiving payment! I can't stress enough how much of a no no doing that was, and it's something people like her pray people like you will do.

That doesn't make you a bad person, just one who had a mental slip for a moment. Other than filing a small claims case and hoping you've saved every single bit of your email correspondence between you both, then that's about all you've got left. I've been a member of eBay for 11 years now, sending something to someone before they pay you is the very last thing you ever want to do, it's almost like giving it to them for free. I know you had good intentions, I know that your heart was in the right place, but you slipped on that proverbial banana peel unfortunatetly and now you either have to endure the pain of the fall and pursue this legally, or just move on and realize you've learned from your mistake!

I'm assuming she's in another state since you pointed out New Mexico the way you did. Maybe Peoples Court, or Judge Joe Brown, or Maria Lopez, or any of the television courts might take the case. If she doesn't pay it's going to be a difficult road for you, one where you have to decide if the bumpy ride in the name of principle is worth it or not. It's sad that people don't honor their commitments, I've seen a few friends suffer this on eBay over the years, luckily I learned from watching them and so far have managed over 11 years with 100% positive feedback.

Good luck,
SnowCajun
