What is the name of your state? TX

Hey everyone. I am going back to court yet again on Dec. 6th for child support hearing. They have yet to serve my ex anything because he has been dodging them and violating my restraining order by calling me up to tell me he is not going to pay a darn thing. Anyways, the last hearing was back in Sep. and they rescheduled it because he did not show and had not been served. They have not been able to serve him with anything in 2 years! The last time I spoke with the OAG, they told me that the case could be completely dismissed because they have not located him. Is that true?? How is that right?? I mean this hearing is to request that his drivers liscense be suspended and and requesting jail time due to his 18k arrears. I am not behind the jail time thing, but the OAG is requesting it. Anyways, do you think they can dismiss it? What can I do to prevent it?

Does your X ever see the kids? Any employment that you know of? Does he visit family?

No, my ex has no access rights to our daughter per co. No employment that they have been able to find. I know his family knows where he is, but they are not talking.

Does the X's family ever want to see the child? I'm thinking downright low thoughts right now in case they do ....
If they do, they have never mentioned it to me. The couple of times I have attempted to contact his family, all I heard was a barrage of complaints of how badly I treated him!

yes, they can dismiss it, for lack of service, and they will.:(

That does not prevent YOU from filing the same petition to enforce and hiring your own process server.

God! That is just not right! How is that in the best interest of the children???

So, are you saying to file again with the OAG? And how do I go about getting a process server? Forgive me, if these are stupid questions! Just a little naive !
