Hi, today I went to court with my wife for a pretrial conference for an old credit account (6 years old) This account is border line SOL time barred. Anyway she responded to the complaint and also requested validation. The plaintiffs party Wolpoff and Abramson for Midland Credit did not show up. We asked for a dismissal with prejudice but the judge dismissed without prejudice. Can we go back and ask the judge to reconsider? Theses people keep harassing and can't validate the debt. If we did not show up there would be a default judgment for the plaintiff. Should the reverse apply as well?

Yes I know, That is my question. They failed to show cause then did not appear in court. We asked for dismissal with prejudice and the judge dismissed without prejudice. Why should they be able to sue again? They obviously could not prove the case or even produce any documents. What stops them from doing this again?

Apparently, nothing. You asked and the judge said no - he can do that, and it's not really something you can appeal.
