Good afternoon, this past May, I informed my landlord that the tiles in my bathroom were falling apart. It looks like mold and/or mildew is growing, and ants continuously crawl around the tub. In the mean time and in between time, we got into 1 or 2 arguments. His response about the bathroom was always, "I'll get to it when I get to it". The whole time up until now my $500 rent has been paid on time.
My lease was from May to May. There was an increase of $50 this May. I requested a new lease reflecting the change. I still haven't gotten it.
Right now I just want to know: 1) Am I still bound by the terms of the lease until next May or can I start looking for somewhere else to live? 2) Can I just move out without notice? Right now, I don't care about security deposit. (although this can change later):mad:

Take pictures of the damage and then send the LL a return rect registered letter to make yoru complaint formalized. in the letter state the obvious , that the floor is failing in the bathroom, that it appears there is mold growing , and that it needs to be repaired before further structural damage occurs. Give him say about 14 days to act , if he doesnt do so then see if your town/ county has a building inspections desk and if they do ask them if they can come out to look at it. ( why do the letter, because it creates paper trail proving you made the complaint so then if LL later attempts to charge you for the repair that grew worse you will have proof you complained) keep a copy of the letter in a safe place.

Thanks for your reply. At this point in time, I don't care about the repairs, I just want to go. Am I bound by my lease or is it considered month to month after the 1st yr? Also, I did request a new lease reflecting the rent increase. I still haven't been given a copy, so I haven't signed it. Which lease am I bound to? Basically, I want to know can I move ASAP? Do I still have to give him notice? Can I just say screw him & leave?

According to the original lease:
3. CONDITIONS,
a. The monthly rent was $500/mo, now it's $550 (but I haven't seen or signed new lease)
b. The term of lease is for 1yr from 7/06-7/07,
c. Total rent for lease term is 1yr,
f. The security deposit is $500,
G. THIS LEASE WILL RENEW UNLESS THE LANDLORD OR THE TENANT GIVES 30 DAYS WRITTEN NOTICE BEFORE THE ENDING DATE OF THIS LEASE. THE LANDLORD OR THE TENANT MUST GIVE 30DAYS WRITTEN NOTICE TO END A MONTH TO MONTH LEASE. h. The length of each renewal term of this lease is 1yr,
i. If the landlord makes any changes, including a rent increase, when renewing this lease, the landlord must send the changes to the tenant at least 30 days before the end of the lease.

So since you're stuck there for another 6 months, you might want to get going on the certified letter requesting repairs!
