What is the name of your state? FL

My bf's ex had a baby (might be his) She claims its his child but doesnt want him to have anything to do with the baby (now almost 5 months old) and refuses to let him have a paternity test done.

He tried to file a paternity case with the court but they denied it because she wasnt served the papers.

Niether of us really know what to do here, and dont have the money to hire an attorney, any help with how to get her served?

thanks

Did you try to serve her? Did she avoid the process server or was it a wrong address? You have to find out exactly where she is and try having her served again. Do you know where she works? Sometimes it is easier to serve them at there place of employment or somewhere that you know for sure they will be.

Your BF will need to refile his petition and have his ex served by either the sheriff or a private process server. A hearing CANNOT be set until the other party has been served. The process server will give your BF a paper called a return of service proving that service was made on such a such date and time.

The other thing he can do is to go to the Dept of Revenue CS enforcement office to begin a paternity action. If you don't know the local number you can call the state number at 1-800-622-5437.
