What is the name of your state? FLORIDA
Yes my charges are over 17 years old ...I was sentenced in 1989 in one case that had resitution , and the judge put it under civil judgment, i did time on that with probation...got out of jail in 1991 got another case went back in 1992 and the judge ran all and any active setence with this case making it one.. I finished all that case 2003 jail time and probation..got my papers saying all probation is completed...so in 2003 in mailed in my clemency papers to get my rights...2007 they call me for the first time and said that i can not get my rights back cause i owe resitution in that 1989 case that the judge but all money in civil judgement.... Can a civil judgement stop me from getting my rights after so many years? If they would have told me in 1990 that ,that would stop me i would paid it over that time frame..I did not know nothin until I got ready to start school in the EMS field...Can they do that? What can i do? The two places that i owe money to..one has gone out of business and the other do not know anything about this cause it's so old..Can i file sometype of motion to dimiss the judgment?:confused::(What is the name of your state?

A: Yes; or ask that the court modify the judgment. You may still have to pay the dough but to the government or a charity or something. Anyway, ask for modification; ask that everything be forgiven. Ask for the farm; settle for a chicken.

:)Thanks Judge... That helped a lot...Do I file in criminal or civil court?..then again i have to pay to file right..then they might say..he can pay to file then he can pay he money .....damn if do or damn if i don't...I had to wait from 2003 to 2007 to get a answer i can wait another 5 to 6 year ....the reason I said that cause they sent my appt. back to me today..;)

Are you financially able to pay? If not, you can file an application with the Court as In Forma Pauper to have the filing fees waived.
File in the Court where your appointment is I suspect.

Thanks..:D I can pay the fee...but do not know how much it will be..I will check...If you are anyone can what to file...what type of motion to file ....if you can...I will search and find them and file them..

I got a reply from the state and the court..they deny my motion ..they said they have no jurisdiction to modify my sentence since it's in civil judgment and they said that I do not set forth a legal basic to set aside judgement...but at end of letter it said I have 30 days to appeal.. should I do that?:confused:

Do florida have a statue of limitation on a criminal civil judgement?

You screwed someone out of the money, which is why you went to jail ...

Not one screwup on your part ... at least two.

Switching restitution to civil is frequently done when probation is over and resti. unpaid.

You should have paid the restitution when ordered, because it was the right thing to do, instead of blowing it off.

Well, guess what ? Your conscience won't, but this will haunt you.

I've seen too many victims of people like you - usually people who were barely keeping their heads above water & they were victimized by predators like you & pulled down altogether.

:eek:I AGREE WITH EVERYTHIG YOU SAID....I WAS 16 AT THE TIME AND THE PUBLIC DEFENDER TOLD ME THAT IF AGREE TO MY RESTITUTION CHANGE TO A CIVIL JUDGEMENT THAT I WILL NOT HAVE TO PAY ANYTHING..JUST COULD NOT HIT ANY LOTTO....19 YEARS LATER GOING BY WHAT THAT LAWYER TOLD ME ..I CAN NOT GET MY E.M.T. CERT....THE MONEY I OWE IS NOT MORE THEN 2,000 I WOULD HAVE PAID IT THEN AND CAN PAY IT NOW... 19 YEARS I COULD PAID 1.00 A MONTH ND PAID IT OFF.....I REGRET WHAT I DID AND CAN NOT CHANGE IT THT IS WHY I DECIDED TO GO ITO TE MEDICAL FIELD TO GET A CHANCE TO SAVE LIVES..I BELIEVE THAT A PERSON CAN CHANGE ONLY IF HEY WANT TO..I WAS YOUNG DUM AND FOLISH..NOW I HAVE 3 DAUGHTER OLDEST ONE 18 YEARS OLD AND I CAN SAY I DID GOOD AS A FATHER.MY GOAL IS TO BE A MEDIC AND THIS'S WHAT I'AM GOING TO DO...
