Continuous False Reports from Ex

What is the name of your state? California

My exhusband violated a domestic violence restraining order in July for which I filed contempt charges - his "trial" is in February 08.

Since I have done this he has continuosly engaged in harassing me by way of numerous filings with the court (judge told him to stop)... sending the police to my home and job repeatedly (premise history on my residence stopped this)... his pregnant girlfriend launched into the mess by calling my job, daycare, doctors, showing to my home then calling the police on me (along with my exhusband) claiming that she feared for her life (restraining order against her stopped that) and NOW he has called child protective services against me for three little bruises on our three year old daughter's arms.

What are my options for protecting myself against more of this insanity.

He is represented by a PD for the contempt charges. I did phone her and leave her a message about his latest antics... she is well aware of the activities of the recent months from her client and quite frankly is just as fed up with him as the rest of the public officials and myself.

Frankly it is not appropriate for you to be calling HIS attorney. If he is harassing you file another complaint with the police. How do you KNOW he is the one to call CPS?

He told me he called them. Plus... our child is cared for very well... he had never claimed otherwise until he started facing criminal charges - then the accusations started pouring in... he'd claim something and request things such as full custody (denied) - asked for her to be evaluated (denied).... the police were on my doorstep SO MANY TIMES after he claimed that he feared for her safety... only to show to my house to find everything perfectly fine (well with the exception of one time her was in her high chair in her birthday suit eating an ice cream :) )

The answer about the attorney is what i was looking for. Had I had been represented by my own legal counsel I know that it would have been ok for them to request on my behalf that he stop the harassment...

Just at my wits end...

I know nothing will come of the claims - it's just so frustrating.

Does the PO forbid any contact, or just violence?
 
Restraining Order

The restraining order prevents from violence, annoying, harrassing, striking, pushing, biting... etc...

Sad news is... my DVRO against him expired... so now there isn't one in place against him at all and the system didn't have a trigger for me to renew - since it was issued by the DA's office when he was convicted of battery... He stayed fairly to himself for the majority of the three years he was under restriction... it was just at the last 4 months of it that he apparently felt all too comfortable to violate it.

I have not pushed for a new restraining order at this point... stupid, I know - at some point though I have to just let it go and move forward and quit trying to anticipate his every next move... my best defence lately is just good living -- rose colored glasses.. haha..

I'll say it again. Remember that the 'visits' corroborate the information that your child is well cared for. Get another one, explain it to 'em again about what is going on. He will continue to lose credibility if he continues on this track.

Thanks!! In FACT! One of the officers that came out to my house was sooooooooo nice.. he and his partner were telling Kalea Jokes...

We'll see how cps handles this... I think once they understand that never before contempt had any suspicions been raised that they'll disregard...
 
Just an update...

After months of anticipation over this... I had filed contempt in July of 2007 - judge would not entertain my motion...too much 'back and forth' - even after I contested - judge said he understood... nothing he could do.

Less than 5 hours later... ex at it agian

The pd for my ex husband told me that I need an attorney 'immediately'

Just looking for clarification - Ex is back at what again? Harrassing you? Or did you get another restraining order put in place as Ginny had suggested and he's back at violating the order?
 
Sorry for the lack of clarification...

My exhusband immediately went back over to the clerks office and filed more papers against me...

The judge had said that he would not entertain any further motions from him unless they had to do with incidents from "today forward". At that point my exhusband said (actually shouted) "You'll have the papers on your desk within a week"

I did manage to point out that since his child support has been set to zero - and that since my motion of contempt of the DVRO was dropped - my ex has gotten what he has wanted out of all of this and there is obvious harassment utilizing the court system going on - I simply asked that the judge not entertain any further needless motions which would cause me to lose more work - I haven't been served at this point - hopefully the judge isn't going to entertain any more... Judge D did say that my ex husbands complaints would have to go through him first - a hopeful indication for me that he'll deny any further requests for hearings.

As for the restraining order requests - he vacated all of them.

I simply do not answer my telephone and have someone with me at all times when we have to hand lil bit off for visitation.

Tomorrow is the child support review hearing - I'm going to try to get the judge to change the order from zero and at least base it off of minimum wage (if the ex hasn't found employment) - I will also try to get him to include my daycare costs into the order as he's been ordered for several years to pay half and ignores my receipts. Insurance costs too - We shall see how it goes.
