How to build product similar to patented one?

I understand that clothing cannot be patented; however, can functional clothing like a firemans suit with special materials be patented? and how do I work around this to build a firemans suit thats already been patented by someone else?

Now lets assume that all of the materials used in the suits build are patented by their manufacturer and trademarked; then I dont understand what the makers of the suit are patenting - is it just special features of the suit or what?

I never said I didn't have an answer, nor did I say no one else had an answer. But you are highly unlikely to get help here with your crappy attitude.

I guess my point is that if you are hanging out at the patent and trademark forum with over 7k posts like you and Veronica then I would hope you could give me a general answer other than "no you cannot" or "didnt you post this already".

Veronica chose to answer my first post which I misplaced into the wrong forum area with "no you cannot" okay, great help veronica. So I built a new example that I thought would be easier to understand - placed it in the correct patent forum and rather than either ignoring my post or answering it helpfully, she chooses to say what she did.

I plan on seeing a patent and trademark attorney pretty soon anyway; but I was hoping to get some general info from people like you on this forum that probably know more than me in this area which I am new to.

How do you know this? Did you or her read the patent? Read the prosecution history of the patent? Read the prior art cited? Unless you've done these things, you can't make a definitive statement as to what is and what is not covered by the claims in the patent.

As to the OP, your question is really too general to accurately respond to. Really, the answer is "it depends." And what it depends on is a lot of very factual issues determined in light of the patents you are trying to get around. And why don't you think clothing can't be patented? It certainly can if it meets the requirements of 35 U.S.C. 101.
