What is the name of your state? OH
My husband wants me to sign disillusion papers that he is drawing up. I want custody of our 2 kids, so does he. Our checking account is in his name only, however I am the one who sends out all bills and writes the majority of the checks. He told me that if I don't sign the disillusion papers than he will call the police and report me for writing checks from his account. If I am the one in the household in charge of paying bills, buying groceries, etc. can I get in trouble for this?

Really? he is an attorney? If he calls them disillusion papers they will never be approved by the courts. (Oh and for some people the marriage license is the first disillusion paper they ever see and/or sign.)

Ohio has a presumption of joint custody.

Whose name do you sign? Yours or his?

Okay. Let him. It won't go anywhere.

He may not be happy but since you were acting on his authority... no. He could try to cause you trouble but....
Look at the following case law:
Chester Twp. Bd. of Trustees v. Bank One, N.A., 2007-Ohio-3365
Jurcisin v. Fifth Third Bank, 139 Ohio Misc.2d 1, 2006-Ohio-5291

Also see the following laws:

He knew what you were doing, he gave you his authority to pay the bills. How long were you married? When did you start writing checks to pay the bills? How did this defraud him?
State v. Curtis, 2006-Ohio-3724

Oh and get yourself an attorney through legal aid if nothing else and do not SIGN ANYTHING he gives you.

No he isn't an attorney.

We have been married 14.5 years.

I have been signing his name to pay our bills since before we were married.
