I went to the courthouse on my lunch hour and got a copy of the final order for support. I am the only person named for legal custody and also primary physical custody. Support was increased from $220 to $909. The judge isn't making him pay for health insurance because "Given the income disparity between the parties and the availability of military coverage the Court will not adjust defendant's obligation for the cost of private health care coverage. The Court also wants to reduce defendant's monthly burden so that he can more readily afford to travel to Alaska to see his children."

In the formal support order, it states The children are eligble for services through military medical benefits and the services are available therefore no additional insurance is required while these services are available.

For uncovered health care expenses (including medical, dental, vision and mental health counseling expenses, he has to pay 25%.

Here is a question I have - since they aren't requiring health insurance other than the military does that 25% pertain to expenses not covered by the military? The reason I ask is it does not cover dental or vision. To be able to afford that, I have insurance through my employer. So since he isn't having to pay for insurance would he be expected to pay 25% of costs not covered by Tricare? :confused:

Any thoughts would be greatly appreciated. Thanks also to each and everyone of y'all who ever took your precious time to answer my previous posts. Y'all definitely put my mind at ease about a lot of things.

It covers UNINSURED expenses. You cannot charge him 25% of expenses you cover. Greedy much? What do you pay out of pocket after all insurance covers? The 25% is of that amount.

I'm not being greedy; I am trying to make sure I understand something. Prior to today, he was responsible for insurance as additional support per our Texas order. He refused to get insurance that works in AK. At our last hearing, the court proposed he pay for 100% of my insurance. His attorney gave the court bad information, and said I dont' have to pay for military insurance coverage; I do (and yes I filed a response). Furthermore, the nearest military facility is over 40 minutes away on a good weather day and because I am retired, my children are low man on the food chain so to speak; it takes well over 2 weeks to get appointments and then you wait hours on end.

Currently, he owes over $3000 in medical expenses from the previous order where he was required to pay all expenses even if insurance was available if he wasn't providing it. I have asked through his attorney for him to pay these expenses. They have not responded; I've yet to file for this to be reduced to a judgement. I know I can but I was hoping he would just agree to pay for the insurance through my job which is $39 more than what he pays right now for insurance in Florida that can't be used outside of Florida (and yes the order says he has to keep the Florida insurance). He doesn't have to pay my premium since it is considered additional insurance.

I was only looking for clarification of the verbage. I wanted to make sure I could ask him to pay 25% of all costs not covered through my insurance. Does this include deductibles and such? All three children are going to need braces and these are not covered by my insurance.

This is probably a moot point anyway since he has already stated if his support was raised to the 33% of his income as required by Alaska law, he would sign away his rights. So I am sure that issue is coming.

Again, the 25% is 25% of what YOU have to pay out of pocket for medical treatment for the children.

I don't think he can do that, unless you have someone lined up to adopt.

He may or may not have to help pay for braces as they are largely considered cosmetic. He may only have to pay 25% of things that are considered medically necessary. I would ask your attorney about this.

And unless he was specifically ordered for such ("to get insurance that works in AK"), he has no control over the policies of the insurance provider he has. Nor does the court. Nor is it his fault.
