Ok Thank you we will copy his airline tickets and his biograhic page of his passport. He doesn't have a stamp in his passport... why is that? and will there be an interview for the I-102?

And why doesn't my husband have a stamp in his passport??? Is this normal? In what circumstances would he not get stamped?

And what will happen if we file I-102, and the I-94 departure slip for some odd reason just happened to have been turned in?

I cannot say why the passport was not stamped. That happens often enough. I also cannot say what will happen if it ws turned in. It would depend on the circumstances. Why don't you just wait and see what happens when you file the I-102 and get a response.
 
Yes, that it what we were going to do.. (= We were going to have a consultation with an attorney before we file the I-102 but I'm not sure if we should or not since I've talked a lot with you....Should we spend money and have a consultation beforehand, or would it be useless?

Thank you SO MUCH for your help thus far!!! I have GREAT news! My husband just called and he believes that some family friends of his mothers have his I-94 along with some important stuff of thiers when my husbands family moved!!!! We are going to verify that it is in fact the I-94 they have tonight around ten so pray for us!!! Praise God and his glory to the highest!! (= I will write back probably about the I-130 & 485 later if it is in fact the I-94 (= Oh Thank you!!!!!

I-94 Issue

Hello everyone!

I am in the same situation. I entered legally to the United States, did not go back out of the country, however I lost my passport along with my I-94. I filed the I-102 replacement form and they came back with a different entry than what I request. They came back with an entry date back in 1975 which was the first time I entered the United States. My attorney however said that we would seek my recidency with that I-94, however at the interview here in Atlanta this week the officer asked when was my last date of entry and I told him that it was back in between 1992-1994, and he said well what you are telling me verbally does not match the one you just handed to me. He also mentioned that at the time my attorneys office filed that did not put the date of entry, they just put unknown entry. Now I am in a big dilema because I don't know how else to prove that I did entered legally and the officer gave something like and RFE with 90 days to provide it. What should I do now? What would be the worst case scenario?

Because I do not trust him anymore. He was not at the interview with me because he could not come to Georgia, and he resides in Florida. He keeps saying that is not a problem this that and the other they will be able to find it I just don't trust him anymore. Reason why I posted here:rolleyes:


I just need some advice.

You need to try to obtain the right I-94 card and if you are not able to do that, provide as much supporting documentation as you can regarding the circumstances of your last e ntry to the US.

can you please tell me for how long INS keeps on record the proofs for entries like I-94,I-95,I entered the country in January,2002,do you think they still keep the record for that.

I don't know how long such records are kept but you should certainly try to submit an application for a duplicate I-94 record.
