how do I file a tax intercept???

Is there any way for me (as a individual) to file a tax intercept for my ex's 2007 taxes???
I have a support order that requires my ex to pay $65 a week for our 2 children. I usually get 1 check about every other month because he will quit his job once they start taking it out of his check. He is nearly $3500 in arrears but my child support case worker in will not file for a income tax intercept because "I have a job and can afford to hire a attorney to enforce my support order". After telling me this about 2 months ago she cut off all contact with me, refusing to return my calls or respond to my letters. 2 weeks ago I contacted the prosecutor about this and he said he would chech into it. Lask week I got a letter from him stating that I would need to contact my case worker with any questions or problems involving my child support. I contacted a local attorney who said I would need to pay him $1000 up front for him to file the necessay paperwork but he could not gurantee that he could get the intercept in place to get my ex's 2007 tax check. He also said I would be better off to have the prosecutors office handle this. I told him what my case worker and the prosecutor told me and he said I should contact the Indiana attorney general. But that doesn't help me right now.What is the name of your state?

You are basing a tax intercept on two assumptions:
1. that they actually file a tax return
2. that there is a refund. Not everyone gets a refund.

Is the court system handling the child support? Or is it coming to you directly?

And that, if they are getting a refund, they don't owe more to the IRS than the refund amount! Because they have very first dibs on any refund.

And that there aren't any outstanding student loans either. I won't see an intercept until the student loans are paid off. :mad::mad:

First of all -- :eek::eek: Are you sure your support worker hasn't changed and that's why no answer? It is not acceptable to be told by child support enforcement that they won't enforce child support. Did you reply to the prosecutor that your correspondence has gone unanswered? I would escalate it within the CSE agency and if you don't get anywhere, contact the federal agency to ask for guidance and assistance:

It's too late now to intercept taxes for 2007.
If you are not satisfied with answers you are getting from the local agencies keep after them, your case is just one in many they are dealing with. So be diligent.

However, its not too late for the future. You need to talk to your caseworker's supervisor. Its totally unacceptable for your caseworker to refuse to put in a tax intercept.

If that doesn't work, then try contacting the governor's office.

Well, that certainly explains why there was no intercept last year for Asshat - the order didn't go into effect til November.

Might explain why he paid so much towards arrears recently too... trying to get it below the threshold amount. Hmmmm.....

CSE has filed an intercept every year but it hasn't amounted to much. The most was a little over $200.00 one year. Every little bit helps though.

DO NOT HIJACK. Do yourself a favor and go to the child custody portion and read the sticky there. Okay? That will keep you from getting in trouble and eventually getting banned.

Actually, I believe even November is too late. Just as a reference...Once a party receives the notice of an intent to intercept, they are entitled to a hearing (within so many days in some states) to contest it. SO, parents should start inquiring in no later than September to get them on the list for intercepts.

Doesnt the Federal government look to see if you owe any money (student loans, child support) before sending you your tax refund (if there is one)? I was in arrears for less than the amount in question in this thread and the federal govt took my entire tax return and applied it to the arrears.

That's because the state sent a notice to the IRS about it. The STATE's CSE filed the intercept notice.
