Ex refuses to move out

Two years ago I signed a lease for a condo on which I put my STBX wife and her son as occupants. Last September, we had a domestic violence incident in which I ended up on “the street” and with a no contact order with her by The Court. At that time I was already on a month to month basis. Immediately after the incident I went to the rental office and gave them a 60 day notice telling them that I would be moving out soon and that I will not stay there, that I cannot affect and I don’t really want to affect whether my wife will stay or leave. I also paid rent for the on going month. Property manager didn’t know about the incident so I explained the whole situation. She said she will ask my wife if she wants to keep the apartment. I said that I don’t really care.

Yesterday my STBX wife faxed me the letter addressed to me from the rental office “Notice to end a tenancy early for non-payment of rent” saying that I owe them some $2000+ for the last 2 months and that they will sue me if I don’t pay or move out. I am not living in this apartment since the incident.
Needless to say, my ex didn’t pay rent for 2 months and refuses to leave.

Are they holding me liable for occupants who refuse to move out, even after I (the lease holder) gave them a 60 day notice??? The property manager didn’t mention anything about me being responsible for them, in fact she said that I’m off the hook with this notice.

Which is it , you had a lease , or were month to month ?

Month to month since my lease expired after a year and I continued living there without signing anything. Note that she didn't sign anything, just an occupant.

Get a Crimianl Attorney. You most likely really screwed up...Do you have a Protective order? If so, you violated it by you actions...

OP , do not reply to her at all .

Send the management your copy of the move out notice , and tell them to direct their correspondences where they should be directed to .

The point I was trying to make BL was that with a PO he MAY still be liable for the rent. Many PO's have wording in them that the abuser is still responsible for the bills they were paying BEFORE the incident. By NOT paying the rent and attempting to terminate the month to month this could be viewed as a violation of the PR/RO.
