My husband spent a week trying to get CSE on the phone and finally took off of work to go down there to get an update on his case. They told him that there was nothing to update him on -- the last letter that had been sent to his ex was returned undeliverable and a payroll deduction went to her last known place of employment in early December and was never returned. He told them that she moved to Atlanta GA and that he hadn't received anything as far as child support since last year when her income tax came to him. The lady told him "they" don't handle any of that there and that the court (????) does everything. She told him that once they track her down again, they will send another deduction form to her current employer.

Hubby is disappointed again. Unsure of what to do. I have no more advice for him because I don't understand how this stuff works. If CSE isn't where we are supposed to go for answers, where do we go?? I just need to figure out what the next step is.

It can be frustrating. He should ask them to do an FPLS on her. Did they tell him WHY it was undeliverable? Wrong address? Did she move and not give a forwarding address? Does he know her new address in Atlanta? What have they done to enforce the garnishment? I believe there is some time allotted for the employer to comply. He should follow-up on that.

If he knows of an address for her, then he needs to go to court and file a motion to show cause on her for failure to pay child support. Keep in mind that he might have to have her served via other means if the USPS fails. But he should also ask that all costs of the action to charged solely to her.

Ah, I see. She moved and left no forwarding address. I think she skipped town because she was being evicted or some mess like that. We do not have an address for her, and she would never give us one. If we could convince her mother to give it to us, that might work, but her mother plays both sides and may give us something false. It's so hard.

It doesn't seem that anything has been done to enforce garnishment. She has had court dates, and whether she appeared or not, I have no idea. There was a motion for contempt hearing in May 07. I check public records but nothing seems to be happening. It just says that they did a CSE Order including Contempt Order ARREARAGE $6721.40 AS OF 5/11/07 and that was back in June of 07. The only thing since then was the undeliverable mail in August 07. My husband and I don't understand this sort of thing very well and cannot afford legal assistance. This forum has been wonderful so far.

So I guess right now we should work on obtaining her current address. I know she's working, but as far as where, well there's no telling.

I live in FL as well and my case is with child support enforcement. I became very frustrated with them and their lack of progress on my case.
I was told that they have a new system in place that automatically sends out notices, suspends DL's, and will do further enforcement action, it is no longer a burden for the custodial parents to call to ask for enforcement. But they still seem to move at a snail's pace. It is very frustrating.
If his x is working any reason why the CSE(Child support Enforcement) computer is not picking up the recent employer?

I have no idea why it takes so long. She doesn't drive anyway, and I don't think she can have a bank account because she's gotten in trouble for bad checks (more legal stuff where I'm clueless). I guess there really is no way to peg her for CS. She just doesn't seem to care and I can tell it breaks my husbands heart but there's nothing more I can do then feel around for ideas. He has hostile conversations with her on the phone because he feels that I've been more a mother than she has in the last four years, but I remind him over and over that I have no rights and I can't do anything about anything. I have medical insurance on my step child and I'm wondering now if I'm even allowed to do that??? My goodness. This stuff is crazy. Kudos to you all for keeping it straight for those of us that feel so lost sometimes.

Getting her address was easier than I thought. I used the reverse loopup on Whitepages.com and got the address where she is staying.

Ha. Handed it to hubby. I guess we'll see what happens.

Florida's CSE is overwhelmed with cases according to our multitude of caseworkers. They work first for the people getting state assistance. I don't want to say they're biased, but it seems like they don't work as hard for the fathers who are supposed to be recieving CS payments.
Tell DH to be a burr in their sides. Eventually, they will catch mom. It took them almost 5 years to track mom down in my hubby's case. She lost both her DL and passport, and barely missed a month in a county lock up.

Florida is definately a mommy state. It's so unfair. My hubby is a great dad, and he works 6 days a week or more to support my step daughter and our daughter. He feels jaded by the system -- but keeps on truckin' it.

Income tax is coming, so we'll be receiving that. At least it's something. Usually about $200 or so. Maybe.
