What is the name of your state? massachusetts

my sons mother had moved with him to vermont and well due to being able to see my son i did not seek court isitation till it was to late. well then she moved to florida and due to finances and such i have not seen him in over 3 years. an nowshe is planing on moving back to massachusetts and i need to know what actions i can do to keep her from leaving with him again and how long i would need to ait to make it happen?

You are way behind t he game on this. Why have you waited so long to file for visitation? Have you been legally ajudicated as the father? Get to court, like yesterday.

Are you legally recognized as the father ?

Are there any court orders involved ? If so what are they ?

Have you had any contact with the child at all ?

How old is the child ?

You would need to petition the court where they establish residency , or petition for a modification , if there is a current order , and request a no removal clause of the child .

You could also request Joint Legal Custody .

Your visitation may start out gradually , depending on the circumstances .

well first i will answer txrose1998 for one i had a lack of information to where she moved my son to when she skipped off to florida. an i had gone tote family court to find any paperwork and they told mei had to go to florida to file anything. i had done that cos i was told by a lawyer that since the state had tryed taking me to court for child support (due to my ex being on assistance at the time) and due to her loseing her assistance all the court could do is tll me once i can get health insurance for my son i was to do so. well i was told since that hapned i would be able to make her come this way to deal with custody but when i went to file anything i was told by the clerk there it ment nuthing.

ok to finish any other info

he is 5 he will be 6 in april
i am on his birth certificate
have had contact with his mother online regularly for the past 3 months

Florida would retain jurisdiction of custody/visitation issues until mom has legally re-established residency in MA. That is probably six months. If mom comes to MA and stays three months, for example, and then turns around and goes back to FL, then she retains FL residency.

How cooperative does mom appear in your online contact, regarding you re-establishing a relationship with the child?

there has been a lot of positive talk about me being able to see him once she moves back. and according to her the only thing she is waiting for to move is being able to transfer her current job.
