Here's a good one for your viewing pleasure:

Bought 2 Game 5 World Series tickets on eBay for a substantial premium. Well, the Rockies got swept, and, consequently, there was no Game 5. Tried to get a refund from the eBay seller who lives in town. The seller told me that he sold the tickets to make money and that he wasn't going to offer any refund. According to him, the only refund due was from the Rockies for the face value of the tickets. The auction does not state whether the tickets are refundable or not.

The auction does state:
"Up for bid are 2 TICKETS FOR GAME 5 World Series home game at Coors Field. I am a season ticket holder and these are my tickets. These are on the coveted club level and are AWESOME. Watch every minute of the Rockies vs Red Sox game while the servers at Coors Field bring YOU food and drink from the comfort of YOUR chair."

Now, I'm of the opinion that I paid a premium to "watch every minute," as promised in the auction, of the World Series Game 5, and that that premium should be refunded if I didn't get to watch that game. Do I have a legitimate small claims case or any other legal recourse against this guy?

Contact the club and see if they will honor a refund to you since you are the possessor of the tickets.
Of course, you are only entitled to the face value of the tickets.

It was not the seller's fault the series only lasted 4 games. Even if you sued, you would only get the face value of the tickets. This is the exact reason many places have banned the scalping of ticket.
