New Make a Wish Question

Since then, I consulted with an attorney who advised me not to do anything regarding custody because then NCP would have visitation established and possible joint legal custody which would be a disaster! (His idea of medical treatment is leave it alone and if it goes away on it’s own then she’s meant to live, but if not it was “her time”.) NCP currently is not seeing MDB and has not tried to initiate any visitation in over a year. Due to MDB’s medical condition, and NCP history of not giving the medicine sent with her, it could really cause her serious medical issues (and has in the past when he was seeing her).

Earlier this week, Make a Wish called me and asked about moving forward with the wish. I explained about not wanting to open a can of worms and said thank you anyway.

The Make a Wish person said they would like to take this to the supervisor for review. I did send them the print out from Child Support that says, OP Custodial parent. They said that, in conjuction with a link to the MD guideline in regard to custody when parents were never married and no motion for visitation was ever filed, they may be able to grant the wish if I can find something to that effect. I tried calling the attorney I consulted with but he’s moved out of state, I have Googled everything I can think of but no success. Then I called Legal Aid, they told me to try freeadvice!

So, I’ve tried to find it on my own and am hoping one of you may be able to provide me with a link. It would make a very special girl indescribably happy.

I presume that the MAW people need some determination of legal custody?

As far as I can tell from all the statutes, if custody is not established by the court, both parents are viewed equally from a legal custody standpoint.

What does your CS order state, exactly, with regards to custody?

What legal documentation do they need for you to prove who her parents are? Is there a father on the birth certificate? If not and you were not married when she was born, I don't see how kind of "proof" they need of legal custody other than what you already have. Do they have a specific document or web page that describes what they need in different scenarios? You can't be the first parent to have this situation.

My order is as follows;

Custodial Parent : OP

Other Parent : NCP

So it refers to me as the Custodial Parent. I don't know, the advice on the previous thread was that I was CP since no motion for custody was ever filed by NCP. That is the same as what the attorney I consulted with last year told me so I guess it's right. He is on the birth cert. and did sign Paternity for CS.

I don't know why they need something in writing, her wish involves no travel unless you count the back yard.

MAW is just covering themselves in case of a law suit, I get that, they initially asked for court order for custody, now they say they might be able to proceed with wish if there is some kind of guideline that MD goes by, due to the circumstances. I just can't find anything that even covers this scenerio.
