My husband and I have a baby but an ex-boyfriend of mine claims to be the "biological" father of my child. He wants to subject my child to DNA testing to prove that he is the biological father but I want him to leave us alone. Can my child be forced to his DNA testing?

If there is a order for testing you mush comply. If there isn't an issue why are you determined to not do this? Its just a swab of the cheek....non-invasive and it will put an end of this concern.

That's likely to be the truth, but its not entirely outside of the realm of possibility that this is an obsessed ex boyfriend.

OP, if there is no possibility that the ex boyfriend could have fathered your child, then you are free to fight a court ordered DNA test based on it being a violation of the privacy of your marriage. That doesn't guarantee that you will succeed, but its been successfully done.

Otherwise, just get it over with.

Even if born during the marriage the boyfriend very well may have a right to petition to establish paternity. All the marriage birth means is that hubby is LEGAL daddy right now.

Simple answer? Yes. You could try to fight it due to your marital status...but I doubt that would be anything but a waste of your time/money. CA loves DNA testing. It just makes sense.

Why not get a DNA test for hubby and baby? If he's the daddy, those results can be used to prove that there is no need for ex-bf to get his own test. Then again, the results could prove the opposite...

It’s possible Mom and Hubby both know exactly who the bio father is.

How many MEN come on here, wanting stepparent adoption and seeking to erase the biological father. Being the legal father of the child means a “happily ever after” for Mom and hubby without filing a thing.

Guess you can’t even preemptively erase a father. Shucks.
