My ex husband is now over $8,000 in arrearages. For the THIRD time since his wages have been garnished he was fired from his job within weeks.

Today - at a modification hearing the judge placed his support at ZERO even AFTER the DA caught him in a lie. When she had taken him into the hallway he claimed we have 50/50 custody of our daughter. YET when he filed his I & E he admitted the TRUTH which is (according to our order) I have 80 he has 20.

So she ran the numbers.

Turns out I must pay HIM $14 per month in child support. (which I fully plan on doing in pennies)

Luckily - he goes up for the contempt charges that I'd originally filed in July (turns out the DA is pushing forward with that) on February 19 for failure to pay child support.

On February 7, 2008 he is facing contempt charges (which I also filed in July) for a terrorist threat against me in violation of a DVRO -

Today's matter was seen in front of the VERY same judge that awarded his pregnant girlfriend a restraining order against me - she showed to the hearing - nothing was done about that either.

I'm telling you - the justice system is SCARY.What is the name of your state?

Those are his charges (classified as a terrorist threat)... and if I may add... the threat was recorded - and later transcripted out by his new girlfriend in a declaration to the court stating that it was "only meant to be funny.."

And I quote "no need to respond, I'm just going to come back and hack someones head off with a knife."

This was out of the mouth of a man convicted of battering ME... so Mr. Quagmire..

If you are going to comment perhaps you should check the posters history first...Just so you don't look ....dumb...like you do with this post...;)

If you don't understand the nature of and terminology used in criminal proceedings you may also want to refrain from responding.

By the way... when we appear on the 7th for his criminal trial... he has a public defender. Am I supposed to have witnesses? It took time - however one MPD officer did actually hear the threat when she was responding to one of his numerous false claims of our daughter being in danger and generating a "child safety check".

The voice mail was purged many moons ago.. however his girlfriend submitted that transcript - is this sufficient?

Also - what, if any, are the reprocussions of threat such as this while under the restrictions of a domestic violence restraining order?

Its not up to you to bring any witnesses, its up to the DA handling the case. Don't be surprized if this one gets plead out.

Oh lord... please do NOT tell me that this man will not have some sort of punishment for this...

what does that mean "plead out"?

It means that the defendant could be offered reduced charges or sentencing in exchange for him pleading guilty. It's fairly common. Talk to the victim/witness advocate and see what they think.

Thank you - I'll call them today.

Something has to give here... it just seems like every corner I'm turning to get this to stop is just making it worse by way of there seemingly being no reprocussions for this guys actions.

He's beginning to look deteriorated - meaning unkempt.. bloodshot eyes... boldly lying yesterday in court - I NEVER in a million years thought I'd say this... however it's getting to the point where I'm white knuckling every time our daughter leaves with him...

I just hope it ends soon - lessons are learned and life goes back to normal for baby and I...
