He needs his wife's permission to file with her on his taxes. And if he do so without it, it is tax fraud. Married filing jointly should get you a considerably bigger refund. Tell your wife that is the way you will be filing and get her ok.Thank you for all of your response. I'll give you a little more info on the situation. My wife decided that raising kids was too hard of a job. She would rather do drugs and sleep all day. So she went to live with her new boyfriend who I have recently found out that she has been sleeping with for a month or so. Yes I know I am stupid for letting it go on for as long as it has but I wanted to keep the family together. I plan on filing for divorce as soon as I have the tax money back. She will not fight me for the kids because she doesn't want them. She has seen them twice since christmas and each time was just for a couple of hours because the were overwhelming her.
My question I guess now is**************.. how can I file, legally, so I get to keep the money. I worked it up on turbo tax (haven't filed anything yet)(I make under 20,000 a year) as married filing seperatly and the refund if a considerable amount. I havn't seen what it will do if I file married filing jointly yet.

I'll just have to split it with her. Unless I can appeal to what decency she might have left and convince her to take a smaller portion so I can have more money for the kids. My Ex did this. We filed our last return together and agreed to split the refund after property taxes were paid from it. Each of us getting around $3,000. The refund came electronically and BAM the money was immediately transferred into an account with only his name on it. He divided it in half, paid the property taxes out of MY half (two yrs worth of taxes) and gave my half to his attorney to hold in an escrow account.And that is called tax fraud...which is seriously punishable by fines and penalties, and could even result in jail time.

Yes, people can do all kinds of illegal things with online filing....and seriously suffer the consequences a year or two later. Its NEVER worth it.
He can't do what you are suggesting that he do without committing blantant identity theft or blatant tax fraud.

Needless to say, he found himself so fast in court where he had to cough up not only the money he gave his attorney that was mine but ALSO my half of the taxes he paid. With interest of course. The judge was none too pleased with him and his attorney's tactics. I also had to wait almost a year before I received the money because they kept delaying divorce hearings etc.
My advice to the OP is to file together, then split the refund with her. SHE is entitled to half of it just as he is entitled to half.

Kind of like the boss that instead of making your colleague pull their load, instead assigns more work to you since you're so reliable. The judges, IMO, just carelessly assign all burden to the party who works or earns more.Of course, you are a woman.
