Evicting a roommate

I have a roommate who is not on the lease and I want to evict. I have told her that I want her to leave in four days and it seems that she is complying with that but want to knwo what steps I need to take to evict her if she decides she dosnt feel like leaving. The month she has currently paid for is up on January 31, 2008. What do I need to do?

You need to use the landlord tenant laws in your state to evict her.

Your roommate sounds like she is a month to month tenant. You would be required to give her 30 days notice.

So I wouldn't even bring her to court to evict her (that is if she doesn't leave) until you have done everything required of you first.

HT is right. Give her the required 30 day notice now. She is entitled to be there for February, but of course has to pay rent. If she refuses to pay February's rent (which will more than likely happen), give her a 3 day notice, then if she is not out in 3 full business days, file an eviction against her in court for non-payment on the 4th business day. (so if you hand her a 3 day notice for non-payment on Wednesday, you would file in court on Tuesday if she is not out.)
