A female classmate noticed at 4:30pm her wallet was missing. She thought she had left it in the break room, but it was gone. She went to the call center director to report it. At 4:47 I received a VM from HR Manager stating I needed to come back to work and sign an insurance paper. I went back in and HR Manager & call center director started to ask me questions about the missing wallet. Said I along with 3 other males were the suspects out of the training class of 15. Police arrived and call center director informed them he had me on tape stealing the wallet. Police viewed tape with call center director. They did not ask me any questions and said unless I admitted doing it then they had nothing. I was then showed the tape of me leaving the training room and walking to the bathroom to wash my hands. Director said wallet was in my hand, again, cops said they couldn't prove anything. So then Director started questioning me about being in trouble in the past even though I had PASSED the background check. I had lied on my application about having a background, I thought after 13 years it wouldn't come up. I admitted to lying. He proceeded to harass me about being a theif and liar in the past then he fired me. This part is not in question. I lied and understand they can fire me b/c of my background.
All of the things that happened between 4:30 and 4:47 are in question. Did the Director cause defamation of character by releasing false & confidential background information.
Director found wallet in Men's bathroom and viewed security tapes. He then showed the victim and other employee tape of me. Director pointed out that she didn't leave it in the breakroom, but in the training room and that was me walking out with it. Victim informed Director I may have a background. Victim called another friend for website to check background, gave Director website and Director proceeded to look up my background with them. The victim and other employee were then sent back on the call floor. They proceeded to tell people about the tape, me stealing the wallet, and my background. There are a total of 70 employees in the call center. Soon after 4:47 I started receiving phone calls and text messages calling me a thief and liar because of all the rumors going around. This was all going on within 20-30 minutes of me finding out I was a suspect. I'm white, the other 3 males are black. I am the only one that has been questioned. This happened last Friday the 8th**************
I live in a small city and it's already difficult to find a job. Now I have rumors going around that I'm a thief with a background. I went to the gas station today and someone there knew about it!
Was it illegal for him to share my background and tell employees I was a thief, before an investigation had been conducted? I have talked with the HR Manager's boss, and she admitted it wasn't handled correctly, but she couldn't say much....
Do I have a case against the Director? What about the company employing him?
