My Daughter Being Forced Out Of School

My Daugher is 5 years old and is currently attending kindergarden. We are now in the middle of the school year and she is being kicked out forcefully not because of bad grades or misbehavior because she is none of that but because she does not belong to this school and school district. I went to the proper steps in the beginning of the school year not even have this kind of problem. In the beginning before I registerd her in school I went to the closest school near me which is right behind my back yard. I was told by this school that I do not belong to that school. They told me to go to another school. I went to the one I was sent to and they too told me the same. I went to 7 schools in total in my city and I was told by all I don’t belong there. I keept being redirected to the original school I have went to. I finally decided to go back and talk to that school and tell them That I do not understand why I don’t go here especailly since this is the closest one to me. Well they finally were willing to help me. They looked in there roster and told me that according to there roster and because I live in a borderline of two cities that I belong to the neighbors city. You see I live one side of the street which is one city and my neighbors right across live in another city. Well I was told because of re-zoneing and building of new homes everything was changed and now you belong in the other city school district. They directed me into the right school which is about 2 miles away. I went to register my daughter there and they checked there roster to make sure I really do belong here. I gave them my address and yes they confirmed this is where I belong. I was so happy that I can finally register my daugher for the school year and this whole back and forth ordeal was finally over, or so I thought. We are now in the middle of the school year and I got a phone call from my daughters school telling me that they did a address scan check and that my daughter is registerd in the wong school and needs to leave. I went to the school district to file an appeal so she can stay and finish the school year in her school but it was denied. I talked to the principle of her school and he told me that basically she has a week to leave because her class is over crowed. They are only overcrowded by one student and that will be my child. There has been 3 other children who have registerd late in the past 2 months and have accepted them with no roblem. Now my child who was registerd since the beginning of the school year is being forced to leave. Is this even legal? My little girl has gained confidence in herself and her education. Knowing how my daughter is she will not take this change well and will have a great impact on her confidence and learning because she does not adapt well with change. This will be devestating to her. She is in a stable learning enviroment and she is being forced out of it because of a mistake this school has done. Whast else can I do to try to keep her here? Are they breaking some kind of education code? This school where my daughter is attending took the responsibily to register and take her in and know they don’t want her? Please Please Please let me know what I can do. I have one week to try to do something

Not to be petty, but your daughter is not being forced out of school. She is being forced out of "a" school. Or, she is being forced into another school.

That being said, it is too bad, but it is legal. The students who entered after your daughter are probably resident students, and many teacher contract have classroom limits. I believe CA's classroom limits are pretty strict.

Even though it will be challenging for your daughter, you have an opportunity to teach your daughter resiliency or to teach her fear. Change is a guarantee. Be positive, and employ strategies that will empower your daughter.
 
You should also talk to somebody with the superintendent's office or the district office for the school district to verify which school your daughter should be going to. It's a pity your daughter has to move schools for this, but at least make sure she is being moved to the correct school so this doesn't happen again.

and you might also try growing up. she is 5 for crying out loud what kind of "confidence in her education" could she possibly have? That they have ALL the colors?????:rolleyes:

If you gave your correct address and did not sign any paperwork indicating the temporary nature of the acceptance, I can't believe the district won't let your child finish the year at the school.

I tried to take a quick search of the education code and that thing is so convoluted I can't tell what sections would even apply. At worst, you would be an interdistrict transfer, but without the proper acceptance there may be a problem.

Talk to the district offices. Unless the class number just got upped for some reason, putting them over the 20 student limit for extra funding, I don't see their motivation.

LMAO FF. This could have been sorted out by calling the school district in the first place.

My search was the same, I'm glad it wasn't just me.

The school accepted 3 new students in that class, so now that class is overcrowded.

The problem will lie in the fact that the in-coming students are "zoned" for that particular school. There is a huge overcrowding issue in most of CA. They are very strict about classroom size and Kinder (I believe) is 20.

Yes the school made a mistake, however she should have confirmed with the District Office before enrolling. That doesn't change that they can move her child to the school she is supposed to attend.

My children live within walking distance of 3 elementary school but ALL are at capacity even with a year-round schedule. They attend a school on the other side of the city because thats where there was room for them.

The bottom line is that they can't ask the children who belong to the school to transfer when , in fact, there is a child who belongs to another school in the classroom. The transfer student moves.
