I am a waitress. The other day, a bunch of us, including the manager on duty, were standing around talking before the lunch rush. One of the employees asked the manager if he thought an actor (I can't remember which one, not that it matters) was gay.

(As a small side note, gay jokes are very common at this place. We have one openly gay guy, and he gets picked on constantly. It drives me up the wall, and I have asked several times for the managers, and employees to not uses the f-word when referring to a gay person.)

My manager responds to this question by saying "I don't know, go ask Justin (if you can't tell, Justin is the gay guy).
I said, "so you assume that because Justin is gay, he would know if this actor is gay?" Manager, "He would know better than I would"
Me "The small minded thinking in this town really gets on my nerves"
Manager "Are you calling me small minded?"
Me, no answer.

About this time, Justin walks in.

Manager, "Justin, do you think so and so is gay?"
Justin, "no"
Manager to me, "See", and then walking off yells, "SHUT UP"
Me, "Excuse me, what did you say to me?"
Manager, "**** YOU" (F**K)

I proceeded to walk out. Do I have any rights in this situation, or should I just proceed to find another job?What is the name of your state?What is the name of your state?
 


Ok, and I am a big fan of free speech btw.

I just don't think people should be picked on based on their sexual preference. I also don't think managers should be able to tell their employees, f u * k you, but that is just me.

I will find another job, I was just curious if I could prevent that type of behavior from continuing.

1. I agree entirely but no laws prevent someone from being a small-minded rude bigot.

2. Nope. Just start looking for another job where managers treat people with courtesey and respect. Good luck.

BTW, you are free to contact the owner/appropriate senior manager and tell them what a jerk this guy is and how he behaves towards his employees.

You chose to let the manager know in front of the others that you considered him small minded. You had to know what was likely to happen. You then threw fuel on the fire by pretending you didn't hear the manager tell you to shut up.

You're making a big show of defending a guy who apparently chooses not to defend himself.

Keep in mind that you're the one who's leaving, not Justin.

The manager apparently gets along just fine with his other employees, who seem to share his views on gays, views that obviously haven't bothered the one who's gay enough to prompt him to quit. I therefore doubt a letter from one disgruntled individual to the senior manager is going to effect the situation much. All the manager has to do is tell him that the OP insulted him in front of the other employees, then walked out. It's possible the OP's lectures to the employees have annoyed them to the point that they're not going to want to support her position in the dispute.

Like I said just talk to a local employment lawyer, etc. Seems like lots of folks on this board just try to talk shlt. I know in South Carolina If I hear you call someone a fag you can be fired. It doesnt even have to be directed to me or anyone for that matter. The same with sexual harrasment. And if one person, regarless of the past, complains and management does nothing then you DEFINITELY have legal rights. They don't know if youre homosexual or not. And some people don't want to lose their job or put up with crap for a while and then start shooting people to let you know "it really was bothering them although they didnt say anything about it."
