Hello, I am new here, but have a situation that is ongoing and I need some advice.
My husband of 16 years and I had an "emotional separation" from August 05-October 06. We were bored with each other and whatever he did during that time, I have no problem with. I do have a problem now, with the adultery he engaged in during that time frame, as she is feeling "jilted" and keeps going to different police departments and making false allegations against me. The police call, ask me if I: 1) Called her on the phone from December 06-October of 07 2) Sent a letter to her work.
My answer is this: 1 time in December of 06, after we "reconciled" I called an unfamiliar phone number on our cell phone bill and it was "HER". Yes, I admitted to the one phone call that she reported 10 MONTHS LATER. The other allegations are false. I was never arrested but we were both told not to contact each other. No problem. I did not say anything threatening or mean into her voicemail that identified her name. Since her complaints, I have received 3 numeric pages from her into my cell saying "call me"...I showed those to my local police and they did nothing and would not investigate, write a report or call her..NOTHING!!!
Then, this past february, the police in the town that she works in, called and asked me if I sent vacation emails to her work. No, I did not, AND the very nice officer said my name or ISP was not linked in any way, but he was just calling to ask. No arrest again.
I retrieved both reports and in both of them she seemed to feel the need to validate their relationship by stating: "the problems started while I was having an affair with *** husband".....
The next report:..."I have had ongoing issues with "bamboozled" because her husband is my ex-boy-friend".....GREAT, so, a whore walks into a police station......LOL....and she is deemed credible enough to file this crap. Then, I get vacation USPS-mail with the names Mr. Nehemiah & Jeanine (then our last name) So, now she is adding her name and using my address!
I went to my local police and they did nothing, wrote nothing, said she can go to the police and call me a suspect to whatever she wants to and she is not committing a crime by pretending she is married to my ignorant husband and using our address. See why I picked the name bamboozled? ANYBODY have any suggestions? I was going to send these reports to her SUPERVISOR for the state of CONNECTICUT-DMR. Can I get in trouble for that?
She is saying the emails went to her WORK, and the police stated NO WAY JOSE.
Thanks for any help with this. Yes I know I should divorce him, but I want to have my mutual fund put in a family members name so he gets nothing. BTW: he has nothing $$$$.;)What is the name of your state?

This seems to be an harassment issue as opposed to a defamation issue. Have you asked your husband to assist you in putting a stop to her nonsense?

You can always attempt to get a restraining order against this woman - so that if she continues to bother you you have some recourse. And you can change your phone number.

Do not send anything to this woman's place of employment.

I thought it was defamation/libel because she is falsely accusing me of harrassment and it is IN WRITING in a police report. Isn't a police report considerd FREEDOM OF INFORMATION ACT? If it is, then I would think making her employer know she is falsely accusing a non-employee tax payer of sending vacation email to her workplace, would put her under investigation at work. She is using worktime in regards to her private life.

My husband did approach her and she denied that she said to the police she was having an affair or he was her "ex-boyfriend". She told him, "the police put those words in, that is not what I stated"....
I think she is jealous because I have one arse instead of 2....hehehe.....:D
Also, the police said I cannot get a restraining order until she physically attacks me.
What about the mail issue? I googled the travel agency on the envelope, emailed them, and they said SHE filled out an online form to have emails and USPS mail sent about Wimbelton tennis tournament. They went to 2 tennis events while they were together.
Then, she files a report with the cops that "SHE THINKS" I did it? How can that not be illegal? Pretending to be someone elses husband and having mail sent with her first name and our last name. Do I need an attorney/ Who knows what else she could do?

You can go to your local courthouse and file a civil harassment complaint against this woman. A civil harassment complaint can be filed when the harassment is intentional, there is a series of harassing conduct, this conduct causes emotional distress, and the conduct is unjustified.

The court may then issue a restraining order to prevent this woman from further contact and harassment.

This is not a defamation issue, however.

You also might have a civil action for malicious prosecution for filing a false police report; however, consider both the cost and that it would extend your familiy's involvement with this person.

Malicious prosecution would work if I WAS ARRESTED, which has not occurred. Why isn't it considered LIBEL, since it is in writing and it is not THE TRUTH?
I apologize if I wrote this in the wrong forum and I thank all of you that have helped witht his ongoing nightmare.
I will take your advice and go to the courthouse in my town on Monday. I love this website. You are all wonderfully helpful and I am very grateful to you~:)

A malicious prosecution suit can only be considered if there is a prosecution and the person prosecuted is found innocent.

You posted at the same time I did, bamboozled. Your trip to the courthouse is your wisest next step.It is not defamation because she has not defamed you.

OP, from your other post it seems that what you want is revenge. I think you should step back and realize that perpetuating the problem through your own actions would likely be counter-productive to your interests.

I agree with las. You do not want this woman to have any ammunition against you. It is best to let her do the illegal and harassing stuff. :)

Thanks, I am feeling FRUSTRATED as you may imagine. I ignored her for months, then she reared her very ugly head once again. I am just trying to end the madness and my local police are worthless....this one is done....case closed....;)
 
Connecticut Practice Book

I went to the courthouse as advised. I was told I need the statute number to file the "Civil Harassment Complaint". I use to have my own Connecticut State Practice book, but cannot find it. I'll keep looking......:confused:
Is there a way to look up that statute online?
Thanks again for any help. I made an appointment with an attorney, but he cannot see me until Friday. If there is a form to download, there is no reason I cannot fill it out.
Do I HAVE TO HAVE an attorney? I am not broke, I have the cash, just wondering is all~

You can go to the Official Court Forms of the Connecticut Judicial Branch at www.jud2.state.ct.us/webforms and there are not only forms to download but plenty of information for you on filing a complaint. Explore the site.

You may want to keep your initial appointment with your attorney, although it is entirely up to you. The filing of the complaint itself can be done without assistance, but you may find an attorney's help valuable.

Sec: 532-183/Harrasment Statute/CT

The Law Library called and said to meet with the attorney (consulte is free).
I was told I would need to file a "temporary injunction" against the harrasser. The form is a bit "wordy" and would need to be altered to my specific situation.
I would like to thank you VERY much Quincy. Your a wonderful person and your helping alot of people that need some direction. Big respect to you!
BTW: My husband approached "the harasser" about her last police report. She told him: "The officer put words in my mouth, the statement is not what I said to him".

Hopefully it will help that your husband spoke with the harasser about the police report. This may curtail any future harassment from her.

It is always possible that the officer who took this woman's report paraphrased what she said, but I am pretty sure he would not "put words in her mouth" - the report should pretty accurately reflect her own words as told to the officer.

At any rate, good luck with the attorney on Friday. Please post back on your situation as it develops.
