I was just curious if this would be considered contempt or not. When we went for the temp hearing, support was ordered and it was ordered to start immediately. Now, it was also in the order that Child support services was going to be the one to enforce this and payments would be garnised.

Of course, services have still be held up because of various reasons and basically just because it is a slow moving system to get going. I'm curious though if because the order says to start immediately, if this is something he should have been doing regardless ?

Since the order has been made final in Oct, I have seen two checks from him .. and when i recently filled out the arrears sheet I had to do, he is now over $1500 behind.

So, is he technically in contempt right now ?

when we paid through New hampshire child support services....our lawyer made clear to us that any payments being made MUST be sent directly to child support enforcement and NOT directly to the ex any more, when it began going through CSE.....

unless there are payments waiting to be sent from him at CSE....yes he would be considered behind in support by CSE, until he could prove he sent you the money after the order went into effect...

The problem with cse is they havent even started anything yet. Unfortunately, I wasnt aware that even though they received a copy of the support order, I still had to call them and ask for an application to get this all going. Needless to say, this didnt happen til a few months went by and I started to wonder where the support was and called them myself.

I did write down the checks he sent on the application they sent out to me, but like I said, he's still pretty far behind since the orders were final.

Is this something that could be mentioned when we go back to court next month ? Or will it just be chalked up to the fact that CSE isnt involved yet ?

Honestly I don't know... My husband pays ontime....LOL

have you called CSE?....you can get the info on the last time they received payment etc....and I do know they can enforce orders, but I am not familiar with thier process..

at 1500, how many payments has your ex missed? (Thats only one month for my husband-I don't think they get riled up by one month alone...)

I do believe they have to be behind a certain amount before its worth enforcing...

If you are going back to court for support issues you could probably bring it up, but not if this is just a custody matter...you "might" be able to get the arrearages tacked on to your regular monthly amount...

In any case you should get some sort of statement from CSE, same as he gets every month to make his payment....it will list his arrearages owed on there, per thier record, which you initially provided.....

It was still up to him to begin paying the new amount on the date the order went through...even if it sat in his bank account until he got the official paperwork from CSE....

I just got the support I am to pay ordered in Dec. We still do not have an order yet, I am unable to pay, I called them at the end of december asking if I could just send it with ex's social security number attached and they said no. So my have to get welfare cause I'm too
lazy to work a real job ex...has been getting public assistance for 2 months that he otherwise wouldn't have been because the system is that slow.....

maybe he's doing what I am doing? I started the withholding from my pay check the day after court and have been withholding since....I just am unable to disperse the money until CSEA gives me a number to attach it to

I'm thinking this may be the case....because it was very clear that once the court order is done...the money can no longer go directly to the CP.

Unfortunately the amount ordered in the temp order was set pretty low, because the ex decided he didnt want to bring in his most recent pay stubs. For some reason he seems to think the court requests means everyone else but him :p His temporary support was set at the 600 dollar range, which hopefully will be changed next month if he actually decides to bring his financial info in.

The temp order took so long to even get back to us, just about four months to become 'official'. We didnt even know the amount that was ordered until we got the papers back.
So that was back in Oct and like i said, they said support to begin immediately. I hadn't even thought of it this way til the last time we were in court, last month, and a person from the support services came up to me to find out the status of my paperwork and to ask if he has been complying with the order. I probably should have just asked her right then if he should have been paying all along, but I was so focused on staying as far away from him as I could ..lol

He handed me a check through my attorney that day after court and has since sent one other check when he got his taxes in, I presume.
As far as his weekly payments, nothing.

It might be the case of him putting it aside if I thought he would even think that way, but my guess is he hasn't ..and is pretty much just sitting back waiting for CSE to make it easier for him.

Just a side note, the Master or the orders didn't really say anything about him not being able to send it directly to me before this went through.
The only thing I could really find on the paperwork was that it was to start immediately.
