Doesn't this sound frightfully like we've had this discussion with the pregnant woman herself????

ETA: If this is in fact the same set of parents, then dad has already filed in California, thus California has already taken jurisdiction because the judge has already ordered her and her belly back.
Turns out you guy are right she used some else computer to singed up and post here, so i apologize for taking your time with this when it had already been posted.

No one beat up on her. She has a court order ordering her to be in CA. She either follows it or faces the penalties for disobeying an order of the court.

As i said there is no court order telling her to return to Ca or tht she could not leave CA.
Not according to what SHE posted. She stated there was an order requiring her to return to California. From her thread:

THe persumed father started custody proceedings becuase he didnt want me to move however after speaking to my brother in laws uncle he said I was still able to move out of state as planned despite the temporary restraining order because my child is not yet born.

THe state of california has since ordered my return by March 1 and the judge said I had no right to leave. I have absoluutely no where to live in california and my doctor will not release me to travel, she says i am too close to the end of term. What can I do?
There was a temporary restraining order issued. And the state has ordered her return by March 1. Therefore there is a court order requiring her to return.
So which one of you is lying -- and I will ever "soften this" -- or which one of you has mis-spoke the actual situation?

You are so mistaken you don't even know it and that San Francisco Family Law Attorney needs his license pulled.

Tell your daughter to turn over or look on the next page of the summons that she received when she was served... there lies as I said before IN BIG BLACK BOLD BLOCK LETTERS a standard restraining order that does not allow the child in question to leave the jurisdiction of the court. That sir, is a court order. Plain and simple, I don't care how you look at it. That said child is still in her belly... well, guess that means she'll need to stay too. So, stop saying that there is no court order, because I know those pieces of paper better than you, your daughter and obviously that attorney. I see them every darn day I'm at work (which doesn't include today because... I'm not there, but I still know that darn paper).

Is he a horrible person? Who cares? She chose him and probably bedded him multiple times.
Is she a raging alcoholic? Who cares if he can't prove it? He can make all the accusations he wants.
Did the court order that kid back to California. You bet your labor pains they did. And she will return, or she will suffer the consequences.

I think i'm confused ... as it is often stated that "there is no child in question" until said child is born. Said child does not exist until birth! So how can a court issue an order for someone who does not exist. What if god forbid something horrible were to happen and said shild never comes to exist???

It is often stated on this website that a father is not a father until he takes a paternity test and that cannot be done until a baby is born. How is it that in this case someone can say that there is a child (and presumably this man's child) .... he doesn't even know yet!! .... and a judge can issue an order at the request of this "man" who is not yet a father????

Sorry ... I know I'm not helpful ... but I was jsut looking for some clarification..

Technically, if the child is born in OR, then OR would have jurisdiction of any matters regarding the child.

However, CA judges have been known to try to assert jurisdiction over children conceived in CA, and have sometimes been successful convincing judges from other states into ceding jurisdiction.

I would suggest consulting an OR attorney ASAP. It may be in your daughter's best interest to immediately file for custody/parenting time/child support in OR as soon as the child is born.
What judges have been known to do this? tHIS POST IS JUST WAY OFF BACE.

http://www.courtinfo.ca.gov/forms/fillable/fl200.pdf
http://www.courtinfo.ca.gov/forms/fillable/fl210.pdf
