What is the name of your state? Missouri. I moved into a new apt. in the same complex of 3 years and after living in the new apt. for a few months I started having issues with my asthma, thinking there was something wrong with apt. I asked them to come in and check for mold (one of my triggers) because there are areas on the ceiling that suggest that there was once water, they did and the said there was non. The service guy left a slip behind saying they were in the apt. which I don't have any longer. I am coming up on 10 months in this apt. and I know there is black mold in the ceiling. Could this be terms of contract termination. I have recently bought a new home and would like to leave early. in the contract it states we can leave by entering a buyout agreement, witch implies we pay a penalty of next months rent plus 2 months and forfeit the deposit. I would like to not have to pay that, but come to an agreement with the landlord since there is mold and I have asked them to fix it, and theres not but 2 moths rent left on the lease. I didn't want to fight it, I just lived with it and don't know why. I have until march 1st to decide weather or not to enter the buyout agreement and pay the penalty. If you have any suggestion on what I should do, it would be much appreciated. Thanks!

Do the buy out. You have no basis to break your lease.

If there is black mold, that can be easily taken cared of. There are many different types of molds and most are not of any consequence.
 
10 months of living with black mold and it wasn't an issue Until you bought a house and wanted an excuse to break your lease? I don't think you have any legal leg to stand on.

The primary reason you want to violate the lease agreement is to move into your new home. Congratulations, by the way! Welcome to the world of real living and maintenance responsibilities.
Now, that you are a homeowner you will begin to experience that other people’s choices should not become your financial burdens. Therefore, maintain the lease until expiration which is less expensive than the buyout option. Lease maintenance will cost two month’s rent. Buyout option will cost at least four month’s rent (depending on the deposit amount). IMO, live out the lease agreement without any violations. It is less expensive and without complication.

Although I agree she can't break the lease for this, why would she do the buy out?

She has 2 months left on the lease but if she does the buy out she would be paying for 3 months plus lose her deposit.

My advice would be to just pay the last two months and officially move out at the end of the lease. This way you avoid the lease termination fee and you have a chance of getting your deposit back.

Make sure you follow all the laws on not renewing your lease, I/E Give proper notice in writing.
