Doctor preformed test without my concent

What is the name of your state? NJ

My doctor preformed a test that I didn't ask for. My insurance didn't cover it & the Doctor will not pay. It is a $242 bill

Also the previous year I was asked if I wanted a certain battery of test & I said yes only if my insurance will cover it. She gave me the tests my insurance didn't cover. $1142.00 bill currently in collections.

Both bills are from the same doctor. Can I take them to small claims court?

No, but THEY can take YOU to small claims court and win. It is YOUR RESPONSIBILITY to find out what your insurance covers before having the test done.

you visiting your doctor to sek medical treatment implies you want him to do what it requires to determine that, including tests that may be needed.

If you did not want the tests, you should have simply said no. Failing to do this gives implied permission for the test.

as to last years situattion. If it is exactly as you have stated, I would argue the point with them. I suspect you did not check to see what your insurance would cover, which is what should have happened. Rather, you depended upon the Dr office to check for you, which is not going to happen.

as ecmst12 stated, it is up to you to make sure your insurance covers something if need be. It is not the dr's office duty to do this althoug I can tell you that my dr's office will check for me if I ask.

If they agreed to check for you and failed, then I would argue it but I somehow doubt they will say that is how it happened.

Just wanted to add....verification of coverage does not guarantee payment. It's every insurance company's disclaimer and the first thing you hear on their recording when calling for verfication of benefits.
