What is the name of your state? New York City
My daughters mother and I split about five- six years ago. My daughter is now seven. A few years ago her mother filled for child support. Not a problem I am all about supporting my daughter and was supporting the day her mother went to fill a case. Her mother claimed that she paid her grandmother 400 dollars in child care a month to sit my daughter after school till her mother came home to sit her. At first the fact that her grandmother was her sitter was true, but from what my daughter has told me her great grandmother has not sat her in quite some time. I estimate at least the last two years. My daughter was enrolled in an after school program that was free and now is picked up by her grandmother who lives with her. My daughter also claims that the her grandmother she lives with sits her till her mother comes home. I pay 300 of the child care she claims. If she needs to pay for child care then fine but I don't think she is paying anyone. How can I go about getting this straightened out?

Are you court ordered to pay for daycare??

Yes I'm court order to pay for child care. I did get school attendance records thats how I know she attended the after school program. What she did was bring a letter from her grandmother to court stating she paid her four hundred dollars a month to come over and watch her. My daughter has informed me on many occasions that she has not seen her great grandmother in weeks months at a time. First my daughter was enrolled in an after school program. Soon after that my daughter had told me that her grandmother that she lives with quit her job and ever since then has been the one to pick her up from school (its been at least a year) or her mother when shes off from work. I approached my daughters mother about my concerns and she defended herself by saying that the money was being placed in a bank account for future use.

she didn't happen to put that in writing did she?

Take your evidence to court and ask for a modification. Don't ask (or expect) your child to testify...

So then isn't she actually managing the after school care for your daughter? Or are you saying that you pay tuition to another institution in addition to your ex MIL?

I'm confused - obviously!!

Further, poster, you will need to FILE for a modification to your order to get it changed. Show your proof.

But you probably won't get "back pay" for what you were paying while child care changed.

I don't expect to have my daughter testify, not my intentions. I just get information from her which she volunteers. To tuffbrk the after school program is free. Silverplum and Zigner I will file a case but don't know what evidence you speak about? Is it not hear say what my daughter has told me.? Cant she just bring another letter in writing like she did the first time and claim someone else is taking care of my daughter? It seems like it can be an endless cycle.

See, there's your problem. You need valid EVIDENCE. If you have that, then you will be in a much better position at the hearing.
