I'm sputtering here...there is free child care available that is not being utilized? Can't he just file that they need to use the free services avl to them or - if mom prefers something that costs money she is free to pay it herself?

Also - do you have MIL's ss# to report? You should demand it if you are expected to pay towards her "salary."

isn't financial disclosure a very common aspect of support cases- as part of his case he could certainly ask for mom's tax returns and then if she has been doing the child care tax credit ask her why not....that answer would be interesting

He has no legal basis to demand the MIL's SS# since he is not eligible to claim a child care credit. Ncp's CANNOT claim child care credits.

most people are not in the habit of turning down money they are entitled to, so if mom says she pays daycare but does not include it on her taxes, I think the answer would be interesting- she may very well have a valid answer but it is worth exploring further

Is there any time between the end of aftercare and the time mom gets home from work? If aftercare closes at 5 and mom is not home until 6 or 6:30, she could argue that the $400 is paid to grandma for picking up and caring for her for that one hour. so eventhough she is already utilizing the free aftercare available she has to pay SOMEONE for that small amount of time.

Just a thought..

however- at what amounts to $16+/- dollars an hour, a judge might find that excessive for day care services

Not if it includes the price of gas these days. :D:D But personally, $100/week for afterschool care is pretty steep - but she is in New York, so maybe not.

Well I believe she works till 12 midnight on most days. My daughter's grandmother the one she lives with is the one that cares for her while her mother is working. I am just concerned about the lies and dishonesty. If your paying someone to care for my daughter then fine I should be responsible to help pay for it, but to deceive me and the courts because it looks and sounds better to say that someone who doesn't live in the household is caring for her and the fact that it is much easier to have a family member forge a letter is wrong. Why lie isn't it possible to say that some one who lives in the same household cares for her after school? Or does the court see this as something that is to convenient and would pass a judgment for less "child care" support?

If she works the afternoon shift, why not modify to have the child with you part of the time? If that isn't feasible, then actually $100/week is pretty cheap for care afterschool till midnight.

I guess its not a lot to ask for if she needs some to care for her 6-7 hrs a day but I don't think thats the case. Is it possible to request that submit her work schedule without asking her?

if you are in close proximity to each other why not ask for first right of refusal, then you can care for kiddo while mom works

Then if that's the case you'll just have to get over it.

You KNEW when you first posted that mom works until midnight and that aftercare is over WAY before that.

Lucky that grandma is around because you'd probably be paying a lot more for care until midnight.

Get over what? I am not upset qurice. Also in my post I said she works til midnight on most days. The last I heard was that her mother worked late but that was suppose to change about a year ago. I pay child support and child care every week I also care for a new born. I should have the right (even if the state doesn't think so) to know what is being done with the money that they take from my check every week (also charge me for the service by the way). The mother of my second child informs me where my money is going and how much we will have to spend on this and that (given we are still in a relationship). I should not be left out in the dark and allow the courts pull money out of my check at will. I know its expensive to raise children. I do what my means allow me to do and beyond that if possible. Never have I once turned away from my responsibilities as a father and I never will.
