The child at the age of 18 doesn't have to go along with the court order.
Agreed but the child hasn't graduated high school yet... hopefully June 08 but it could be June 09 due to bad grades.

How does that work when the "child" turns 18 i still have to pay support but the "child" doesn't have to go along with court visitation/counseling orders?

or ?

You file to stop paying child support on the argument that if the child is emancipated from a court order for visitation then he is emancipated from support as well.

You can certainly make that argument, and it might fly. However, I know of many cases where it hasn't flown at all.

And I know of several where it has. In fact there was an Ohio Supreme Court case where it worked. Does that mean it will work in California? No. But if he doesn't try it I know for a fact that it won't work.

I did say that it might fly.

Correction... it was an Appellate decision. Risser v. Risser (Ohio App. 3 Dist.) 173 Ohio App 3d.

Finding that child was emancipated for purposes of visitation likewise was emancipation for purposes of child support.

The arguments were interesting and it can be applied more than case specific.
