insurance question

hello all,
just wanted to get some feed back on this. my ex-husband has quit his state job.he carried the insurance for our two boys with this job. he has stated that they are still covered under the insurance until may 1st. when he gets a different insurance for them, he will send me the information, and their new cards. ok.....fine with me. the question is************** can he provide insurance for our boys through his new wifes job? i know that she cant claim them (legally) for coverage, but it wont surprise me if he tries to do that. the way i read our court papers is " he must carry the insurance for the two children or pay 100% of the medical bills incured during the time not covered by insurance." please just give me all the feedback possible. again.... i just want to stay 10 feet ahead of this guy so i dont get screwed. thanks!!

Yes, he may use his wife's insurance, if the insurance company allows it. And yes, that meets his court ordered obligation.

My Ex's Ex actually carried our daughter on his insurance when they were married and even after they got divorced (and I have excellent coverage, ex just didn't want to use it). She was taken off his plan once he quit his last job and the new job would not allow him to add our daughter on. Then, my ex started to use the insurance I provide for my daughter.

If they are together and have a family plan, a lot of times, it will cover step-children.

As stepmomanddad stated, most insurance plans will cover step-children regardless of where they live. My wife carries my son on her insurance and did so even prior to our marriage. The insurance company allowed her to carry both myself and my son (i am NCP) on her insurance prior to our marriage as - domestic partner and a child of a domestic partner. The only difference that was stated was regarding whether it would be pre-tax or after-tax cost. It ended up being pre-tax, so we were happy with that.

If your children are provided with medical insurance ... why does it matter to you who is the responsible party. Your ex is taking care of his obligation by providing medical insurance for the children.

I am not familiar with medicaid and how it works? If he applies for a state program I believe that they would take into consideration the availability of medical insurance for both parents. Is insurance offered through your employer??

My ex carries our son on her husbands insurance as well, since they have another child there is no extra cost to her. I don't know what your situation is, but can you add the children to your insurance as well, then you don't have to worry if dad is providing it.

Also whoever has the insurance gets the EOB statements and knows what the child has gone to the doctor for. Of course OP should be informing the other parent of that anyway. But it makes it that much harder to keep it a secret.

My ex carries the insurance and I receive all EOB statements, he does not receive them to my knowledge I imagine if he requested them from the insurance carrier he'd have them. I am the one taking our child to the doctor 99% of the time so I always put myself as the person responsible for payments. Mostly because the way our order is worded I have to pay all copay's and out of pocket expenses and give him a copy of receipt with in 30 days to be reimbursed for his portions.

I don't understand why OP would care if the ex's new wife is carrying the children either. With out assuming she has sinister motives the only thing I can come up with is that she is worried she may end up being responsible for what the wife pays for them on insurance and that's not how it's supposed to be...? I don't know... but my ex carries my oldest daughter who is not his biological child on his insurance. I pay for the children's portion on his family plan for the entire year at the beginning of the year. That way she is covered. We do not include it in child support, and the judge did not care when this was explained in court. It doesn't matter to me who covers her, as long as she has insurance... I think that is the courts point as well. He also covers any live in or even non live in girlfriends he has... don't ask me how he does it, but I don't ask questions. That's his and his employers problem!:cool:
