Paypal Won't Give Me Back My Money

My father and I both have Paypal accounts. However, my social security number is on his account, and his is on mine. His account is 5 years old, but mine is just a few months old. My account was locked up for "security reasons". I was then supposed to prove my SSN, and I told them about the mix up. So they locked up my father's account, too. They emailed my father so he could send in his information proving his SSN. After he did that, I sent in mine.

Two accounts cannot have the same SSN. They cannot add my real SSN to my account since it is already on my father's account, and they cannot add his SSN to his account since it is already on mine. I sent them the same information they requested, but this time, my father and I put it in one envelope so they wouldn't get confused.

Then Paypal wanted more information, like who my suppliers were. After going through that for a while, it went back to the SSN issue. They are now requesting the same information that my father and I already sent it separately and then again together. I made several calls to their customer service department, but get no where. I was finally told that one account has to be downgraded to a Personal account. That would remove one of the SSN so that the other could be changed.

My father's account was going to be downgraded. He emailed the request, then called. They couldn't do it for some reason. A few days later, he called again. This time, he got Kieth. Kieth couldn't do it because there was a server down. Kieth said he would take care of it by tomorrow. Tomorrow came, and his account was unlocked, however, it was not downgraded. The next day, his account was locked up again and Paypal wants the same information that they already received.

My father's account has 47 cents in it. Mine has $999.14. I want my money. After two months of doing this, I still cannot get the money out. From what I found online, mainly an eBook called "How I Sued Paypal and Won", it looks like this will go on forever, unless I sue. The author recommends suing in small claims court for the amount that is locked up. I have to fight the whole venue issue, since their Terms of Service says I have to sue in San Jose, California, but I am in Ohio.

Here is the bigger issue, though. I recently bought a building to open an eBay consignment shop. My only job is to sell on eBay. While my Paypal account is locked, I don't have seller privileges. So in the 2 months, not only did I not make any money, I couldn't get the money out that I did make. I had the electric and gas shut off in my building, and I am on the verge of getting evicted. I also have clients that brought in their stuff, I sold it, but cannot get the money out to pay them. They aren't too happy.

Should I get a lawyer and sue in civil court? Should I take the author's advice and just sue in small claims to get my $999.14 back? Can I sue in small claims for my $999.14 plus a little extra for pain and suffering?

And, a possible larger issue - over $1,000 you had all your utilities shut off and are going to be evicted? You may want to reconsider the feasibility of your business venture.

EDIT: On second thought, the eBay user agreement may mention binding arbitration - so you *may* not be able to sue in SCC - check the user agreement.

Your father has had a PayPal account for five years but has never noticed that your SSN number is on it instead of his? You got your account a few months ago, and his number is on it instead of yours. I don't get how that could happen. Anyway, PayPal could have handled things better, but I can see where they were coming from.

You can't get your money out but you "recently" buy a building to use to do eBay - which owns PayPal - business with? Oh boy.

You'll need to do more checking because it may not be worth your while to sue for that amount. And save a little blame for your dad unless he can prove some sort of glitch changed his SSN to yours and vice versa. It's always a good idea to check any account from time to make sure the information is as it should be.
