Ex is Laid off

What is the name of your state? FL (But I go thru WI laws as that is where the divorce took place)

My ex husband just got laid off in WI, but he says the child support will go in the arrears? Is this correct that he doesn't have to pay me at all and then it will just start up again when he gets a job??

Also, don't know if I can post here, but the children want to come back from summer visits with there dad early as extracurricular activities (sports) that they are in practice starts before school starts up again and he will not let them return for this. When I call his home to talk with him about it, his wife keeps hanging up on me and will not let me talk to him about it. I notified him 6 months before about the sports they will have to be at for practice and he will not talk to me about it. I try calling and emailing and no response at all. I caught him at his mothers house last night and he says he can't even give me a return date on the flight. He is bitter that I left him and says this is all about me and not the kids and that he will never let them come home early for anything. The kids are very hurt and angry with him. Frustration is setting in!!!!!! I have let him have the kids 4 to 7 days longer then he should have them for winter break every year. It is bad enough he gets them every Christmas. Sorry if this post doesn't belong here.

your support question may have been misunderstood. he may have said his child support will go into arrears. which means he may be deciding not to pay (since he has no income). so the order will still stand, he will just be behind. in effect he may be required to come up with a payment plan to catch up once he is employed.

is the child support payed directly to you or is it through the child support agency in WI?

Was his layoff involuntary?

If it was, either of you can (and one of you should) file for a temporary modification. If that is not done, and ex does not pay, arrears will accrue.

if he receives unemployment compensation you will still get some support, maybe not the full amount, but you will get some

The economy in many sectors here in WI is in really lousy shape. I, myself, was laid off for about six months, and we have several friends who were also laid off. All of us are respected professionals in our fields, with long, stable work histories. Fox Valley, especially, is affected, as are several SE WI counties because of losing some national HQs. Harley Davidson is also laying off, as is Midwest Airlines. World Bowling congress just left the state. MGIC took a big hit.

Personally, When I was living on unemployment, I cut back considerably on what I spent on everything, including on Kiddo. But it's good for kiddo to learn that one must not presume everything is always "coming to them" and that making due with less for a while is not the end of the world, because love from parents, even if they can't do as much at the moment as they'd like, is most important.

Ex will need to file for a modification. But if he's involuntarilly unemployed, he'll probably get it. After all, if you and he were still TOGETHER, and he lost his job, you'd instantly see a drop in income from him, wouldn't you?

If he was laid off & isnt getting paid, what do you expect him to pay you with? Of course if he has no money he will just accrue arrears.

If he gets unemployment, you may get some of that.

And, if he has trouble finding a job, he may even qualify for a reduction, as he is NOT voluntarily underemployed as one is not laid off for something they did wrong, otherwise they would call it being fired.

It is through the child support agency in WI.

I don't know, he told our daughter that he got laid off. He won't talk to me about it.

Funny, I use to work for the World Bowling congres in WI years ago!!! LOL...

To be honest with you, "I" don't want his money, but the kids need it. Here in Florida it is horrible too. I am doing anything I can to make ends meet, I work 3 jobs to get by. I do know that he works under the table, and good for him to get away with it, but I think any "loving" father would send what he could.

I just wanted to understand how it all worked. My current husband was laid off to, but he was required when he got a job to pay the normal support amount, plus a percentage of what was behind until he got caught up. Which he has done. Did not know if that was the case in every state.
 
aaaaaaaaaaa I think I know that. Like I said, I'm not out to make trouble for him as far as child support is concerned, just wanted to know how it all works.
