What is the name of your state? California

I play a online game produced and ran by the Disney corporation called "Pirates of the Caribbean online". To be able to continue my game play past the free account limitations, I became a paying member. In the last 2 months since i joined, i have been suspended for a second time last week.

The first time i was suspended, they said i violated terms of service by giving someone my my-space name written in code to get past the chat filter, along with a transcript of chat logged of the incident. i went back and read the terms of service and no where could i find that i am not allowed to give any personal info. The web sight instead put these rules in a separate part of the web sight that i was not required to sign as i was required to do with the terms of service. my problem with that was that i felt that since i signed and then was required to again sign the same terms of service, that those are the rules i have to follow that they should not have the right to limit my freedom of speech, especially when i never agreed to it.

i wrote them an e mail explaining the situation and how that according to their terms of service i have done nothing wrong and that they should lift my suspension. All that resulted was an e mail saying that my email has been sent to the proper department and i then still had to wait threw the 72 hour suspension, and never received any communication back.

i feel Disney has no right to sensor me as an adult beyond not using foul language, or insulting or slandering someone else in the game. people on line should be able to exchange basic contact information to be able to converse as friends or as they please outside of the game. I feel my civil rights where violated.
------------------------

The second suspension all that i received was a e mail stating"We are writing to inform you that we have placed your account on hold while we investigate a possible violation of our Terms of Use and/or House Rules." however no decisive reason has ever been stated since then.

to reactivate the account not only did i have to wait 72 to hours but call customer services to speak to a representative. when i call it is a message service asking for my account name, real name, phone number, and best time to reach me. i have done this daily for the past five days, with no call back other then on the second day being a Saturday, i was called. when called the representative had my account name wrong and the second i corrected her, she suddenly said that she was beginning to have technical problems and that they would contact me back with in the next day. since then i have not had any response. My problem with this situation is that i have not been given a reason for the suspension. I was charged automatically the same day i was suspended and now am going on the 6th day with services not rendered.

I have decided that i will just place a call every day for them to call me back so that i may have records showing my intent to contact them. other then that i do know know what if any of my rights have be violated, from right to speech, to privacy that all my chats are being logged, to possible credit card fraud for being charged but not allowed access to my account.

Any information would be greatly appreciated, as to my legal options to look into.

It's pretty clear about your responsibilities...and their responsibilities too.

If you can't follow their rules, I suggest you call and cancel your account and move on to a different game.

You can feel it all you want. It doesn't make it true. Disney is a private company and free speech/expression rights as outlined in the Constitution don't apply. No civil rights were violated. Disney is allowed to censor you all they want for whatever reason they want.

Play something else if you don't like the way Disney handles their business in regards to this game.

Second sentence of the agreement....

By using this Service, you agree to this Pirates of the Caribbean Online Game Member Agreement, the Disney Terms of Use [http://disney.go.com/legal/conditions_of_use.html], and the Disney House Rules [http://disney.go.com/guestservices/netiquette.html] (collectively, the "Agreement"). If you do not agree to each of these documents in their entirety, please do not use the Service.
So, can we infer that you didn't READ the agreement before you signed?
