How bad will it look if dad stated in court (at least 3 or 4 times) that he would be willing to do an every other week schedule and then I request a settlement based on this and he does not agree?

I think he is trying to back out now.

Settlement negotations are NOT usually admissible. So you don't request a settlement but you request that the COURT ORDER IT based on dad's own words.

Ok, so if negotiations between our attorneys does not work then at our next court date request an order based on dads testimony, correct? We are supposed to go back in June for day 4 of testimony but I have advised my attorney to try and settle at this point based on dads testimony.

One more question...

Can we have the every other week agreement typed up and signed and then request the judge to decide on the smaller issues that we don't agree on?

I am sure he will want stipulations that I must take the children to all extracurricular activities. I am hoping that he will agree that he transports during my week if he signs them up. I am not wanting him to do all transportation for activities. My concern is that my oldest son will miss out on tutoring sessions because of conflicts with his younger brothers sports.

The other issue will probably be medicating our oldest for ADD. I am wanting psychological testing for learning disabilites in conjunction with the ADD testing. He is wanting him to see a psychiatrist for ADD testing. The issue I have with this is the fact that a psychiatrist can't do all the testing. I think it would be neglectful of us to not rule out the other possibilities. I also think we should try the tutoring prior to medicating for ADD.

Holidays will be an issue but those I am not worried about. I am not going to hinder my relationship with our boys over who gets Thanksgiving.

AFAIK, psychiatrists don't do testing. That's why they have psychologists. :p
I don't know what AFAIK is. I know that psychiatrists don't test. I spent a long time on the phone with the Board of Psychologists in NC. Dad has son seeing a therapist (social worker) She diagnosed son with ADD. She recommends he be seen by a psychiatrist if dad wants him medicated. I am wanting him seen by a psychologist because (I know my opinion doesn't count) IMO it makes more sense to have the psychologist do all the testing and rule any other issues out due to the fact that attention issues are symptoms of so many learning disabilities.

Sorry...I came off a 24 hour shift this morning and haven't had my nap yet. :)

I have tried to explain all of this to dad (when he told me the social worker did the psychological testing). regarding why we should do it in this order. I think I am hitting a brick wall though.
