I recently purchased a set of wheels for my truck on eBay. They were listed as new, but were, in fact, used aluminum wheels re-plated in chrome. When they arrived at my dealership for install, I was told they were damaged. When I got there to inspect, there were several spots on all 4 rims that had bends, cracks, etc. I could deal with that, but the rear wheel had a large chunk taken out of its edge. The part that bothers me was this chunk was still shiny from the chroming process, indicating that it was present prior to chrome. Even the smallest amount of curb rash will take the chrome down to bare metal, so I decided to state my case to the seller.

He immediately blamed UPS, then the Dealership, for causing the damage. We had words back and forth, where I requested he replace the damaged one. No chance of that happening, so I filed a grievance with PayPal. They immediately closed the case saying it wasn't their policy to deal with quality control. I was a little upset by this, but it makes sense...I guess. :mad:

Now (to my question), I feel it's worth the $900 I'm out to continue to find a resolution with this guy. If I have to take him to small claims court, where is the claim filed? He lives in California, I live in Iowa. I've never had to do this before, I don't know the process. Will this fall under CA Law, or IA Law? Would the claim be filed for the 1 wheel with major damage ($900) or for all 4 wheels in the auction purchase ($3,200)? Do I need a lawyer to get this moving?

I appreciate any advice anyone might be able to provide. Thanks, in advance.

You would file in California. It is your choice if you want to sue for one wheel, or the whole set (since 3 out of 4 rims won't work for you.)

File another grievance with paypal and point out that the ad said new but they were used so he misrepresented the item. This is not a quality control issues it is a misrepresentation issue. Read the ad carefully to make sure he advertised new chrome wheels and not new chrome plated wheels.
